Question

Me and girl friend have a house togather and two kids found her cheating and now I moved out what kind of rights do I have???

Answer

Well, you are not going to the primary conservator since you're the one who moved out. That's not 100% true--depending on a lot of other facts, but it's probably true.

The house is a separate issue.

You can file a Suit Affecting the Parent-Child relationship. The court will give you visitation rights and make you pay child support. You can have the AG to this for you for free.

Good luck!!

What happens when a company issues common stock for 40000 and uses 30000 of the cash to purchase a truck?
When a company issues a stock, it is first assigned a par value,it's an arbitrary value, commonly $1. When the stock is sold, assuming that it sells for greater than par, the cash is enteredinto two seperate line items, Common stock and Paid in capital inexcess of par; this goes straight into Stockholder Equity. When thecompany buys the truck, (and this will sound backwards) they credittheir cash account and create an account in their ledger for thetruck and debit it for the amount they paid for the truck;accounting ledgers have two volumns that have to balance, Debit andCredit. They generally will create a depreciation account for thetruck as well and accumulate the depreciation on the truck untilsuch time as the value of the truck on th books equals zero or theysell the truck. The tricky part comes if they sell the truck formore than they have left on the books for its value, when thathappens they have to back and refile taxes for all the years theyclaimed the deprecition on the truck.

Question

Legal Custody after Death of Custodial Parent-

We live in Maryland. I suffered a well-documented abuse from my children's father and he is unfit mentally to raise them. He has abused them mentally during visitations in the past.

What do I need to do that will assure that my children's father will not be granted legal custody of our two children if I, (their Mother and full-custodial parent) should die? I want the children to stay with my husband (the step father) who has been raising them. They are 12 and 15 yrs. old.

Thank you very much

Answer

It is extremely difficult to foreclose the right of the biological father to seek custody of his children. You could try filing a petition to terminate his parental rights, but if he fights it you will probably lose if all you have to base it on is mental abuse. You would have to have your children thoroughly examined by a child psychologist or psychiatrist who would be able to testify that they are being harmed by any contact with him. Unless you now have some kind of terminal illness, actuarialy you are extremely unlikely to die before they reach the age of majority (18) and custody becomes irrelevant.

Question

I have a elderly friend wants to change his trustee and lawyer; in 2009 he signed a amendment his trust did not understand clearly the content; his lawyer and trustee put a clause sais he must get written consent from them for any changes;

his trustee stuck him in a resthome last year he was miserable in and then refused to change his medical trustee per his request; he recently got a girlfriend and wants her lawyer to be his, wants his accountant to be his trustee; he is pretty upset does not have liberty make his own changes as he may freely choose; how can he fire his trustee and lawyer ? Tx

Answer

Obtain yourself an elder abuse lawyer/trust litigation lawyer, who can file a petition to have the trustee removed, his advance healthcare directive changed to someone else, be placed in a care facility of his choosing if he needs that type of living facility, the accountant named as the trustee. I would advise him NOT use the lawyer of his girl friend as that sets up the possibility of conflict of interest for the lawyer as well as for himself and girl friend.

Answer

I agree that he needs a different lawyer to avoid any conflicts.

Question

good day; I am a line cook and a couple of months ago I dropped very hot water on my foot at work while the owner was standing there talking to me. I did not seek medical treatment for several reasons; 1. a regular customer was there (a surgeon) and he told me how to clean and care for it at home. 2. I have no insurance, and could not afford time off work.

The wounds healed well, but left a lot of scarring. Question; can I seek any kind of workmen's comp?

Thanks for your time. Steve

Answer

Yes.

Question

Hello

My name is Timothy Jackson. My question is:My former company informed me they were removing my position from the company so of course I was laid off making @$17 per hour. But this is the question.I have found out they hired a former employee who was just released from jail at $12 per hour to do the same job I was doing.During the release of employment. My co-employer informed me this was a business decision.Do I have a case here in Florida? Please understand. For the last five years I have received three raises without asking for them. That is what type of employee I was.

Thank you

Answer

Employers are free to hire and fire as they see fit, provided those hiring and firing decisions were not based on some form of discrimination. You were an at-will employee, and you therefore can be terminated for any reason, or no reason at all.
