I got my first speeding ticket for doing 62mph in a 30. I live in New York and I'm required to show to court. Does this mean I'm automatically considered not guilty and need a lawyer? Or will I/ should I please have the chance to plea guilty in court?
Answer
You have the right to do what you want but why would you? Pleading guilty has automatic consequences. Your insurance will most likely go up, You will be paying a court fine, the New York State Drivers Responsibility Assessment and 6 points on your license. At lease make the state prove their case. You should get an experienced traffic attorney and fight, give yourself a chance. Good Luck
Answer
A speeding ticket alleging a speed of greater than 31mph above the limit requires a personal appearance or representation by an attorney. You face possible action against your license including possible suspension, points, insurance surcharges and a driver assessment fee. You may have defenses or plea-bargain opportunities depending upon where the case is being heard. You may contact my office @ 718-834-0087 for a phone consultation.
