My mother was in a minor car accident last year where she was at fault. We are insured but the lady who she struck is threatening to file a lawsuit against her if the insurance company does not cover her medical bills. She is asking for half of what our policy's maximum was. According to the insurance company they are attempting to settle but the claim is still open. If they do not accept and the lawsuit is filed, will she be forced to appear in court? What can we do to prevent this?



Answer

If suit is filed, the policyholder will have to cooperate in any litigation defense so she might have to appear in court. If the case settles before trial and most do, then she would not have to appear in court.
