My husband was sentenced to jefferson county work release on a shoplifting ticket due to his prior criminal history. I am scheduled for brain surgery on Dec 22, 2012 and will be unable to care for my three children for a duration of 6 weeks after the surgery. I have no other family to help out and my husbands family is all in Arizona. He is my only alternative for caring our children while I am recovering. His release date is 1/1/2013. What are the chances of asking the judge to reconsider his sentence to house arrest or any other punishment that would allow him to be home during this time? It is only a matter of a weeks difference. I am unable to reschedule this surgery and my Dr says that I should be getting this done sooner than later but obviously cannot do that either due to his incarceration.

write the judge a letter explaining the situation, make sure you include your husband's name and case number and send a copy to the DA, it can't hurt.
