Question

When signing a Durable Power of Attorney (finances).....in CA do we need 2 witnesses AND NOTORARIZATION ? May the witnesses be relatives (i.e. daughter, a cousin.., husband or wife, sister )?

Answer

A DPA only needs to be witnessed by a California Notary. Additional witnesses are not required.

Answer

A DPAF can be witnessed or notarized. It is preferable to have it notarized because that will allow the document to be recorded. It is best to not have any relative act as a witness.

Answer

I think a relative is OK, so long as it is not the relative who is acting as agent (or his/her spouse or child)
