Question

If I have sole custody of my children both legal and physical and my ex-husband has not participated in their lives for the last eight years can he be granted visitation rights? He has a long history of drug and alcohol abuse as well as a violent past. He has been in and out of rehab centers, jail, and homeless shelters. He has not held a job since 2002 and is currently back in rehab. I recently filed for child support and I think that this is his way of getting back at me. Should I be worried?



Answer

The children have a right to have a SAFE relationship with their father. If he petitions for visitation contact, ask the court to require drug testing and supervised visitation.
