We are one year into a three year lease on a commercial property. We fell behind in our rent and the owner/landlord gave us a 3 Day or Quit notice. We had conversations with him and got current on the rent within a week. He accepted the back rent and never pursued the notice further. He has since put the building up for sale and the listing has made no mention that the property is under lease and occupied.
Is our lease still valid? What are our rights under these circumstances?
In subsequent conversations with the owner, he says that he has received two offers on the building and the new owners would want us to stay provided we enter into a 5 year lease at terms that would increase the rent significantly over the term. I want to make sure I understand our legal position before I enter any formal conversations.

Unless the lease specifically provides that it may be terminated upon a change of ownership of the building, it will remain in effect when the building sells. The only thing that happens is you get a new landlord. (It is different when the sale is a trustee's sale due to a foreclosure). You can enter into a new lease with the new owner if you both want, but you don't have to. The existing lease is unaffected by the sale.

I agree with Mr. Whipple. Unless the lease provides otherwise, the new owner is subject to the existing lease, and steps into the shoes of the new landlord. He or she cannot require you to sign a new lease until the existing lease expires, and subject to the terms of the original lease. (Such as renewal options, etc.)

I agree and write to clarify Mr. Whipple's answer only because this is a public question and answers. It is not ALWAYS different if the sale is a trustee's sale due to a foreclosure. Even on commercial leases, if the lender took their deed of trust after your lease was signed, with knowledge or reason to know the property was leased (which they would have required the landlord to tell them to qualify for the loan) your lease would survive the foreclosure. If your lease post-dates the deed of trust, however, Mr. Whipple is correct that it would wipe out your lease. It also would wipe out post-dated easements, as I learned when I litigated that issue and had to break the bad news to the client who found himself effectively landlocked by a CalTrans curb-cut prohibition.

After the incident I had no contact with my ex, until the detectives working the case asked for my help to find out where he was so they could arrest him. I agreed and after several attempts to have him meet me, he finally did. After I knew where he was staying I contacted the detective and gave the specific cross streets. Two weeks later my ex calls me and invites me over to the house. The cops show up a few hours later to arrest him. I was also arrested for "hindering prosecution". I am not aware of any law which would require a bar to provide free water. Even though the actual cost of the water is minimal (though not $0), keep in mind that the bar either has to clean the glass or pay for the paper or plastic cup and have an employee available to serve you. If you do not like the way this particular bar does business, perhaps you should try another pub.

Hi, I live in California. I have a WC case open. In 2010 I injured my lower back helping a co-worker as she ran over her foot with her electric scooter. I lifted approximately 450lbs. I developed a herniated disk and had to go through PT and later that year a surgery to remove hernia between L4 and L5. My primary Dr. have written a PR4 to workers comp and have given me a 13% permanent disability rating with future medical care for my injury and a comp of $12,500. My adjuster have mail me forms to be signed by me in order to be approved by the Worker's Compensation Board Judge. I still have pain in my lower back and I develop numbness after being standing or walking for more than 20 mins. My Dr. said it may never go away. My questions are: Does this seem like a fair deal? Am I being treated fairly from WC? Should I seek legal representation now before signing any paperwork? Thanks.

Unless your written contract says you can, no. (If you are in business you should have a lawyer and he should be writing your contracts and he should have written various remedies to protect you. If you made the bad mistake of not hiring a lawyer to do your contracts you missed that opportunity).
You may, again depending on the paperwork and whether you have acted quickly enough, be able to place, with a lawyer, a lien on the property, and then use the courts to collect. Again, see your business lawyer, as you should have a procedure in place with him for such collections.

I agreed to pay partial rent for several additional months after my son moved out only if they agreed to replace me as guarantor. Even if there was no wrong doing by the others, as a guarantor you are merely telling the landlord that if the students do not pay you will pay, but you retain the right to get the money back from them. Your problem is that they are students so probably have no assets. You need to try to help the landlord find replacement tenants so that your obligation to pay rent ends as quickly as possible. You need to contact the roommates and find out if they will pay you back and how they will guarantee that [will their parents guarantee payment; will the school help at all].

If all sentences were run concurrent, he's looking at 8 years. If the sentences were run consecutively, he could do 16+ years in prison.

I gave my 30 day notice on Aug 1 with a final date of Sept. 1. They completed an inspection on Sept 4. We inquired today the 24th about the status of our deposit. We are being told that we forfeited our deposit because we did not complete the terms of the autonewed lease. They are also charging us rent for the Month of September. We left the house spotless so we should have gotten back most if not all of our deposit. And I can live with paying them rent for september. but the problem I have, it that they have already rented the home to new tennants. Is it legal for them to charge me rent (and it has clearly been defined as rent and not a penalty) if I do not have access to the home because new tenants are already there.

Illinois law does not address whether or not you are legally obligated to sign a performance improvement plan. However, you should make sure you understand what your signature means: does your signature mean you agree with the contents or does your signature mean you agree that you recieved a copy of the PIP? Your employer might view a refusal to sign as insubordination and fire you. The general rule in Illinois is that an employer can fire you with or without cause and with or without notice so long as the termination does not violate a contract or anti-discrimination laws. If the termination does not violate a contract or law, cause is important in determining if you are entitled to unemployment benefits. Since your employer can fire you without putting you on a PIP first, I'm guessing your company is following its own internal policies by putting you on the PIP. In my opinion, now is a good time for you to have an advocate on your side working with you behind the scenes. A good lawyer should be able to guide you through this process and help you either preserve your job or exit under terms most favorable to you.

Two things come to mind. If your District Attorneys Office has a child recovery unit, you may want to get your court to pick up the child. In the alternative you may contact the D.A. Child Recovery unit in the county where the mother resides. Possibly also contact the police department where she lives to go with you to pick up the child.
Ultimately though, once back in court, the amount of time you waited to get legal help to recover your child, may work against you. A qualified lawyer could help. Good luck!

I'm located in Florida. I own a home that I entrusted a property management company to handle. We selected a large company that manages hundreds of properties in the area. We're at the beginning of our tenants 3rd year in the property, as they signed a 2 year renewal after the first year. We've had constant issues with the management company not doing their job, but the most recent seems to have caused damage to the property. Every year we have an AC company go out and do an inspection before the summer months to ensure the AC looks in good shape. In April the AC company we chose was a little overzealous and wanted to do some extreme repair, even though the AC worked great. They informed the repair guy at the property management company, who called me and said something doesn't sound right, because the issue they are referring to usually just needs a $150 test, and $400 repair. He suggested they may be trying to get a large commission from a new unit, and that we should give his vendor a chance to get a 2nd opinion. After that we spoke by email, and he offered us their vendors services by email, and on 2 seperate occassions we responded to have his person go out and take a look, and let us know what needs doing.
We heard nothing, fast forward to August; we have an email from the same guy saying that the AC isn't working anymore. We forwarded him proof that we instructed him to take care of the issue back April, and asked why he didn't and he's refuses to respond. He also won't tell us the nature of the issue. Only thing he would say it that, "last time it happened the tenant cleaned to line and it worked, but it didn't work this time". Since he's never contacted us about any tenant reported issues, we have no idea what he's talking about, and no idea what or why the tenant is doing repairs in the first place.
We're angry because we feel they are in breach of contract by not following our instructions to send an AC guy out to determine what work was needed; and also by not reporting issues to us, and allowing the tenant to do his own repairs. We want to know if there's any recourse for damages available, and what options should be available to terminate the management agreement.

The best advice I can give is to take the contract you have with the management company and schedule a consultation with a local attorney who can assist you with this, or at least give you the answers you need. There will likely be provisions in the contract related to what constitutes a breach and what remedy is available, as well as your duties if you feel there has been a breach. The contract will likely govern the procedure for termination of the agreement as well.
Unfortunately, I don't think you will be able to get adequate answers to your questions and concerns through a forum. There needs to be an exchange between you and the attorney so that specific questions and detailed answers can be provided.

At first it I couldn't have been happier with it but soon after it was completed it was discovered the concrete mix was bad and that there was some sort of mineral mixed in that was causing the concrete to leave quarter size holes in it. I asked a friend of mine to add me onto his Citibank credit card as an authorized user a few years back to help me build a credit history. In Jan 2011 he stopped paying his credit card bill and what we both didn't realize is that it showed up on my credit history as well. On my credit report now Equifax and TransUnion show a "Chargeoff or Collection" for the full amount of the balance due or 26,364. And there is a comment that says "cancelled by credit grantor" It did not show up on Experian for some reason.
I never even used the credit card and he removed me as an authorized user awhile back (unsure of when) and this is still showing up on my credit report. I'm preparing to write a letter to Equifax and TransUnion to dispute the charges and wanted to know if there are specific statues in the law i should reference or if just explaining the situation is enough. I can also get a signed letter from my friend stating this is his debt and have it notarized so it's kind of like an affidavit. Please advise.

It's a 12 month lease but in my contract it says that I need to give 30 days notice in writing if I intend to leave.The tenant won't let me out but withheld some of the original lease she signed with the landlord from me such as pets being allowed and a lead-based paint disclosure. Is there any way I can get out of this lease? I can't afford to stay and I found people interested on Craiglist in the place but the tenant who subleased to me says they only want someone from their church or from their school?

If your sublease says you only need to give 30-days notice to the prime tenant, that's all you need to give. The prime tenant's lease with the landlord is their problem.

A year ago I got caught smoking marijuana in my dorm room. I got caught with 2 grams of marijuana and a few pills of adderall. After they found the adderall the cop said to me, "just so you know adderall without a prescription is a felony. Now, we're not going to file it that way and we may not even file this with the state". (It was campus police). I find out a year later ( a few weeks ago) that they did file it with the state and gave me a felony and a misdemeanor and this was my first offense. Never been in trouble before and they didn't even arrest me. What's the least charge I could get out with this? Is there anyway that I could say the cop lied to me?

I am assuming that you were never arrested and only recently found out that there is a warrant out for your arrest? The least charge you could get out of this is whatever a skillful attorney could plead it down to. There may even be an issue to get the case dismissed, but your attorney will have to talk to you and get the police reports to determine that.
The police can lie to you all day about what charges they are or are not going to file. It does not matter and is not going to get your case dismissed. The fact is that the police just turn in a police report to the District Attorney, and the District Attorney is the one that decides to file the case and what charges are going to be filed.
