If it's a civil matter, you may be out of luck. Most civil judgments in the U.S. are never collected. Naturally, you can try the execution / garnishment route, but if the person has no assets from which to collect, or you can't find them, it may be best to simply move on with your life.

It depends. Technically, they can still collect and it is a valid judgment. You will have a hard time avoiding it since it is abstracted into the County Clerk's office with your Date of Birth, Driver's License, Address, etc. That is where the credit bureaus get their information and add it to your account. If they are really aggressive, they can file for turnover orders and get to your non-exempt property/bank accounts. Or if they figure out the mistake, they can file for a corrected Judgment while the Court still has jurisdiction. The recording lasts 10 years and can be renewed another 10 years. It would have been much better to not get to that point... if it is withing 10 or 30 days, you can file a motion for new trial if you can show why you did not answer originally. I doubt that this question has ever been decided by the courts, at least not in a published appellate case. Technically, the trimmed limbs "belong" to you, since they came from your tree, but I believe most judges would think that tossing the clippings back to your side after pruning them off was a bit in excess of his rights (to remove the trespass) and unnecessary to "protect" yours (to have "your property" returned to you). I hope you can resolve this amicably.

Because my ex saying that my son wont be put back on his insurance anytime soon, does he have to pay in full for any medicines I get over the counter or any hospital visits after my insurance pays for their portion? The answer to the first part of your question can be found in the court order where the responsibilities of the parties regarding health insurance and payment of uninsured health care costs are described. This language is usually lengthy and can be confusing. In general, if the father isn't carrying insurance you can put your son on your insurance and dad should reimburse you for the extra cost to you. If you don't have insurance available you can check out CHIP. If that isn't available, you will have to see what the order actually says about dad paying if he isn't carrying the insurance. Most orders will say he pays 100% of any uninsured costs. The second part of your question dealing with keeping the child away from dad must be answered "No". You don't get to keep your son away from his father because dad isn't carrying insurance - or isn't paying child support, for that matter. The issue of illness after visits may be a reason to change the possession order, but you would need to discuss that with an experienced attorney.

I agree with the response of the other attorney and stress that no matter how much the father is violating the order by not providing insurance, covering medical costs, or otherwise failing to provide court-ordered support, you can NEVER use that as a reason to withhold visitation under the possession schedule. You can deny visitation above and beyond what the court has ordered but you cannot deny what is ordered because support is not being paid. The Family Code is very clear about that.

It appears he has violated the current order by canceling the child on the court ordered health insurance. The judge should not be too pleased about that.

If his home is a danger to your child's health, you need to discuss that with an attorney. You might need to take your child to his pediatrician and discuss why the child needs his mediation at the end of every visit. Your son might need to also visit a therapist regarding why he needs his mediation at the end of visiting his father. Something sounds suspicious to me. A therapist can be called to testify at court regarding the child's mental health.

Why let it go that far? Just return the engagement ring if you have it.

Assuming that a money judgment is entered against you, PA only provides limited exemptions. You can have up to $300 in any one bank account and a Bible, work clothes/uniforms, your clothes and if you are a seamstress with a sewing machine, that. There are some other exemptions (for retirement, insurance proceeds etc.) but there is no homestead exemption and no exemption for a car. There is for bankruptcy, but not state court judgments.

However, that does not automatically mean that the plaintiff will have the sheriff seize your stuff. Most creditors want money, not your personal possessions. There is no real market in used furniture and household goods other than yard sale value. Also, while there is no homestead exemption, do you own land? Is it mortgaged or are you married and is the land owned jointly by you and your spouse? If so, the land is safe from seizure. Regarding a car, is it still financed? If so, its probably safe too. And cars are depreciating assets so that when its paid off, its not worth very much.

And you can always file bankruptcy and seek to get any judgments discharged. Or you can make payment arrangements or try to save up the funds to pay the money judgment at some point. But its so much easier if you have the ring to just give it back.

$5,000 to $6,000 just to amend deeds does not make sense. Either more to this is involved or something else is not right. Is it possible that by adding these people, this is treated like a "sale" of some kind and that fees are owed for transfer/realty taxes?

However, since you have an attorney, it is not fair to either your attorney or any attorney here to second guess the attorney doing the work. He or she has the documentation and nobody here does so any advice we can offer is speculation.

You need to ask your attorney why the cost is this much and to explain how the fees are calculated. If they truly are just charging exorbitant fees, then fire that attorney and find someone else.

We had a pool built and had an agreement with our neighbor that any damages to their property from the pool construction would be paid by us. The pool was done in the beginning of December and in mid-Feb we received a notice that their sprinkler system was damaged from our construction and that their plants and grass needed to be replaced as well since they could not be watered. The backhoe imposed on about 2 feet of their property line during construction and we re-sodded this area. We've had the pool company inspect their property and they say that it is unlikely that the neighbor's damages could have been done from the construction. They are now telling us that their repairs will be done at the end of April . My question is are we responsible for paying for these damages when there is no concrete evidence that anything was damaged from our construction. Who has the burden to prove their side here?

Only the states Attorney presses criminal charges for adultery. i do not believe that there has been any such charge placed in over 50 years. If you want to seek a divorce on the grounds of adultery, you are entitled to do so, but it does not give a leg up on anything and in fact may adversely affect you - judges do not like such public airing as it is on the record forever.

Of course not. You don't have the authority to dictate how the police and criminal justice system does its job. Even if you did, what damages have you suffered from the way they handled it (which does not include the initial incident)? Have you contacted the police to get a copy of any report (i.e., what effort have you made)? The police may or may not have handled it differently, but that does not mean you have a legal claim. You can still certainly press them to pursue charges, if they are not doing so (do you know?).

As to whether the school can punish the child, it might depend upon the known standard of behavior established by the school or district. You file suit in the county/state where your sister-in-law and brother reside. If it is different states, I supposed you can sue each in small claims for $1900.

Whether you will recover anything once you get a judgment is questionable. PA has no wage garnishment, but NY does. However, I cannot advise on NY law so you may want to consult a NY attorney about that. You will have to testify at any hearing and you will have to prove that this was a loan and not a gift. Do you have written proof? You do have some part repayment, but unless you have a written promissory note, it will be difficult. People lie every day in court and its her word against yours. If she is smart, she will say it was a gift.

Have you made a written demand on her for the cash? If not, I would advise you to do that now. Ask her to respond to you. Offer to settle in a lump sum for less than the $1900, or, if she does not have it, then ask her to make arrangements to pay in installments but see if she will sign a written promissory note and get her to pay the installments plus a reasonable rate of interest. You are not a bank and she does not get interest free loans. Tell her in the letter that if you do not hear from her you will pursue further legal action and give her a definite time period of 15-30 days. People play games with certified mail - you might be better off with UPS/FedEx and get the tracking info to prove that it was delivered to her.

If she does not respond then go the small claims route but you must sue her where she resides. If you want to sue in PA, that is fine, but you will have to do that in the court of common pleas assuming PA has jurisdiction over her (was the loan made in PA? Does she still live in the state?).

You and your wife should demand (subtly, of course) that the owner provide you with a written estimate of repairs needed to his vehicle. Also you should ask him to provide pictures of the damage so you can assess if it was consistent with the apparently minor wreck in which the parties were involved. If the owner refuses to provide any written documentation or pictures I would only pay money if the owner is willing to sign a release of all claims arising from the accident. Otherwise I would wait to see what he is going to do. One other thought is to report the accident to your wife's insurance company but if it truly is a minor accident I realize the concern of even apprising the ins co of a potential claim and what that may do to your wife's insurance rate. In the end you may want to consult with an attorney in person and obtain advice as to how to proceed.

If you are attempting to settle the matter out of court, simply ask the other driver to get 2 to 3 estimates from reputable repair shops. Generally, a fair settlement will be an amount between the lowest and highest estimate. If the other driver doesn't want to cooperate and you believe $500 is too much simply don't do anything - it will then be on the other driver to file suit and prove damages in court (assuming your insurance company doesn't make the decision for you). BTW $500 in damage is virtually nothing, you could hit a squirrel and do $500 or more in damage.

I owe $700 to a collection agency because my roommate didn't bay his last months rent or pay his share of the damages. I called the collection agency and they said they can accept 480 to remove from credit. What can I do to get this removed from my credit for cheap? I'm thinking of hiring a law firm like lexington law to help repair credit.

Simple answer: you CANNOT get this removed from your credit. Any company that claims they can do it is possibly doing something shady. You can have inaccurate items removed, but if you signed the lease and your roommate didn't pay, then you are unfortunately liable just as he is unless he pays. This would be legitimate on the credit report. What some companies do (I know nothing of Lexington Law's procedure, but will say that only non profit agencies or licensed NC attorneys can do this work in NC without the possibility of a crime occurring) , they will file a dispute as to the item in question and then send you a report with the item removed...what you don't get is the corrected report when the debt is substantiated and put back on the report.

When you settle with the creditor, they will note the account paid in full, which is helpful, but they lied if they told you they will remove it from the credit report. They have no power to tell the credit bureaus to do so.

Attorney Love is right. You cannot get this legally removed from your credit IF this is a debt for which you are responsible.

However, there is legal and there is .... quasi-illegal. I have heard of cases where a debtor pays in full and the creditor takes off the item. And I have had situations for clients where things just went south and it really wasn't the debtors' fault that the debt went delinquent and I asked nicely and the creditor agreed to take it off but that was because of the special circumstances in that case.

You can hire a lawyer if you want ... me or anyone else but I would not recommend Lexington Law. For one thing, they are not licensed in NC to my knowledge and if they are practicing in NC then its unauthorized practice of law. However, the debt is small and you want to get out of this as cheaply as you can. You can settle this yourself and do the dispute letters if needed if you do it correctly.

First thing - debt collectors LIE! All the time. They can say anything to get you to pay including promises of removing the debt.

Why exactly did this end up on your credit and why did you not pay it before it went into collections? Did you and your roommate both sign the lease? Did the lease provide (if you know) whether you and your roommate were jointly and severally liable? By this I mean that if either one of you did not pay then the landlord can seek recovery of the back rent from either of you. Or did the lease just provide that you would solely be liable for your share of the rent and your roommate for his share? If the former, then why didn't you pay? If the latter, you are not liable at all and in that case this debt can be legitimately disputed. You first have to dispute it with the credit bureaus and then with the debt collector if the credit bureaus refuse to remove the debt. The dispute must be in writing and sent via certified mail. If you have proof that you are not liable and you dispute this properly, then you can sue for damages and recover attorneys fees - which will be a lot more than the debt owed.

To the extent you are liable for the debt but can make a reasonable argument why you were not at fault here (or if you can show how the landlord messed up too), maybe you can get this removed if you pay the creditor. Even if you cannot get the item removed legally, then I still would settle the debt for whatever is a fair sum if you are legally responsible for the debt. However, get a settlement letter in first indicating that the full amount of the debt is $700 but the collector will accept $480 as settlement in full and that after paying this amount there will be no further collection activity on your account and that the debt will be reported as "paid settled" to the credit bureaus. Send the payment via money order or bank certified check and keep a copy of it before you send. Follow up in 30 days to get a closure letter acknowledging receipt of the funds and that you owe nothing more and that your credit report will be updated. Keep the settlement letter, closure letter and copy of the settlement FOREVER. Seriously. Debts have a way of re-surfacing - I call these "zombie" debts. You want proof in case that happens. Send the payment via UPS or FedEx so you can prove that the collector got it too. I have had problems with the USPS and certified mail.

After 7 years, this debt will drop off your credit report. However, unless this is the only black mark on your credit, the more time that passes the less this debt will affect you. There is a score simulator at www.myfico.com somewhere and you can see what your credit score would be if this debt was not on your report. You also can add a 100 word statement to your report - about this debt. I don't know how much weight this will carry with lenders. Car lenders will not care and still loan you the funds. Mortgage lenders are going to want this debt paid off before they lend money.

I am familiar with Lexington Law - from what I know - they play what I call the "credit report dispute" game. By this I mean they take your money and send a dispute letter to the credit bureaus and hope that the creditor does not verify the debt. If that happens, the debt is removed from your credit report. If the debt is not resolved, the debt can be re-added by another debt collector or junk debt buyer though. I would recommend saving your cash rather than spending it on Lexington Law.

Though you supposedly came here looking for guidance, you're clearly only looking for affirmation. Answers that aren't what you hoped for just make you angry. But the problem isn't with the answers. It's with the person who won't listen to them. That's why you lash out at me personally instead of considering that maybe, just maybe, I know what I'm talking about.

If this really isn't about the judgment but rather about changing the law, then you should go to the Legislature. That's what it's there for. Its job is to make the law for everyone to follow going forward. The courts' job is to resolve particular disputes that have already arisen. Part of that job involves spelling out the law, resolving ambiguities and filling in gaps left by the Legislature. But setting policy is not their job. It's the job of our elected officials.

You liken yourself to Anita Hill, but Prof. Hill testified in Congress and did not seek remedies in court. (She also appeared only because she had to; she didn't set out to take any action involving Justice Thomas.)

Your insistence on straightening out what you consider problems in California law "by federal appellate case law" is misguided. The federal courts will never pass judgment on any state's laws unless those laws conflict with federal law or the federal constitution. And even then, they will only do so in a case that is procedurally proper. Since yours was a civil case that was decided in a state court, the only procedure available to you was to petition the U.S. Supreme Court to take the case. You had a limited opportunity to do that, and you didn't do it. Your time ran out years ago. To lash out at me for telling you this is to shoot the messenger instead of heeding the message.

There are laws which limit the jurisdiction of the state and federal courts. You act as if those laws don't matter, but they do. The courts are not free to ignore them under any circumstances. Even if judges on either a state or federal court agree that you were the victim of an injustice, and even if they share your outrage, they will be powerless to intervene.

As I said in response to one of your earlier questions, our system of justice has its flaws. It was designed by humans, it is operated by humans, and humans make mistakes. The system should be better than it is, so that it would make fewer mistakes than it does. But it will never be perfect. Some injustices will always occur. The appeals process exists to reduce the number of injustices, but sometimes it does not succeed. Even so, every case has to come to an end. Yours ended long ago.

Let me offer an analogy: We have extensive criminal laws and a vast law-enforcement system in this country, but sometimes crimes go unpunished. We could pass more laws, and we could hire more police, but society has settled on the current system for now even though it means some criminals will escape justice. We can only approximate perfect justice, and our society has decided that the way we approximate it now is acceptable -- even though some injustices will slip through the cracks.

The same principal applies in civil lawsuits. Our courts are just a rough approximation of what they ideally should be. Some cases yield unjust results, even after the appeals process has ended. That's not a good thing, but it is reality. The people who suffer from that reality must come to grips with it, or else it will consume them the way your situation seems to be consuming you.

I don't know whether the result in your case was as unfair as you claim, but I assume for present purposes that it was. You have my empathy. I have seen serious injustices before, and they make my blood boil. But at some point every litigant runs out of options. You reached that point long ago. The best thing you can do for yourself is to find a way to accept this reality. The best thing I can do for you is to help you accept it.

If you want to lash out at me some more for doing the best I can to help you, then that is your privilege. It would not be just, but justice rendered by humans is imperfect. All we can expect is that those who dole it out do their best.

My prior response glossed over your angry discussion of Anita Hill. I don't want anyone to think I agree with what you said about her just because I didn't address it. She's not relevant to your situation, but you seem to feel she is. And you misunderstand why she testified.

Prof. Hill had worked for Clarence Thomas at the Department of Education and the EEOC. When he was being considered for the Supreme Court, the FBI interviewed her (and many other people who knew him) as part of its normal background investigation. She told them about her experiences with him, including the incident you mentioned. Her comments went into the FBI's file. She did not try to make a bigger deal of it than that. She just answered the questions that were put to her.

She did not initially appear at Thomas's Senate confirmation hearings, and nobody asked her to. Then, when the vote was approaching, someone leaked the FBI's report about her interview to the press. It was all over the news, so the Judiciary Committee reopened the hearings and called her to testify. That was their idea, not hers.

She was not there to advocate for any changes in the law. But there was already a bill pending which would expand the relief available in federal sexual harassment cases. The first President Bush had opposed this change, but he dropped his opposition after Hill's testimony focused attention on the issue. Congress passed the law, and the President signed it. Prof. Hill didn't write the bill, she didn't lobby for it, and she didn't testify about it. She was just a catalyst. And at least from where I sit, the legal system became more just as a result.

Thomas's (alleged) conduct was at least highly inappropriate. But it was especially noteworthy because, when it (allegedly) happened, he held very important jobs where he was responsible for enforcing civil rights laws. The incidents would have drawn less attention if he'd been in a different type of job.

As for calling Prof. Hill a "dingbat": She's an honors graduate of Yale Law School, a tenured professor at Brandeis University, an accomplished lawyer, and a respected scholar. Your disdain for her -- and for the laws against harassment -- is hard to understand.

Without seeing the paperwork and the timing of the property transfer, it isn't possible to say.

A power of attorney, however, cannot be used after the death of the person who granted the power. If the transfer occurred after the death of the person who issued the power, then there is likely a good argument about the attempted eviction.

The only way to handle this is to speak with an attorney. I strongly suggest you contact one at your earliest convenience.

Mr. Perry is correct. A power of attorney expires when the grantor of the power becomes incapacitated, unless it is a durable power of attorney, and even then it expires on the death of the grantor. In addition, if the holder of a power of attorney acts contrary to the wishes of the grantor of the power, and that can be proved, the act is only valid as to bona fide purchasers for value; otherwise it is possible to set it aside. Look for a form "Response" to whatever he filed against you. Complaint in Paternity? Petition to Establsih? I would need to know more. (But its NOT going to be called a Response to Application for Default).

I enlisted a business partner to join me in purchasing a franchise business. Our intention was to quit our jobs to run the business. We each signed the Franchise Agreement. We started an S-Corp, with my partner as the VP and I as the President (51% ownership). We signed for a $70,000 SBA loan. We signed a commercial lease for the retail location. I fulfilled all obligations to get the business opened. Two days after our Grand Opening, my partner refused to quit her job and join the business full time. She did work part-time (about 20%) while I put in very long days, many unpaid, to cover the other 80% to get the business off the ground and keep it running to pay the bills/loans/lease. It is now 6 years later, and our SBA loan is almost paid off. I have notified my partner that I am not going to renew the lease and will not continue in the business. She has no intention of keeping the business. We are trying to sell, but it did not make any money, so we will probably just close it. I have made it clear that I have no obligation to pay the remainder of the SBA loan, as my time has paid off my share, but she insists my legal signature obligates me to pay half. There will be about 5,000 left to pay. What are my options in this situation? Unfortunately, we did not have a partnership agreement, just a verbal commitment.

I work at Rubio's Fresh Mexican Grill in California, and when I was hired in April of 2010, my starting cashier's wage was $8.25/hr. I am still a cashier to this day. We had a managerial switch in August of 2010, and with her came an $8.75/hr payroll for cashiers. I just found out today that cashier's now are paid $8.75/hr, and was never placed on the new payroll which began back in August of 2010. My manager never informed me I was still at the old pay while my entire colleague congregation of cashier's got a higher pay, MANY of which I trained. I have been missing out on the extra $.50/hr I should have received a year ago, yet my manager states "since you were on the old payroll and manager, you cannot switch to the new payroll as a cashier". It's unlawful that I am payed less than my fellow cashier's, and have trained them all and have been there the longest. What legal actions can I take in order to gain the lost money back and get on the new payroll, which they refuse?

I am sorry to have to tell you this but there is no legal obligation your employer has to pay you anything more than minimum wage. The terms of an employment relationship is based on contract. An employer offers to pay a certain wage and the employee either accepts employment at that wage or rejects it and looks for work elsewhere.

Based on your post, Rubios never agreed to pay you anything more than $8.25 an hour. The fact that it agreed to pay other employees a higher wage does not create some legal obligation to pay you what it is paying them. There is no law that says everyone performing a certain job must be paid exactly the same.

Now, if you have evidence that the real reason you are being paid less is due to race, gender, age, or any other basis upon which to form a discrimination complaint, you should discuss that with an attorney to see if you have the basis for a case. But if this is simply a matter of Rubios not treating you fairly, you are out of luck and your only option is to find a job that pays you more.

I'll answer politely and without sarcasm.

The store can detain you, and can search you, and can have you arrested, if they believe you are shoplifting, meaning leaving the store without paying for everything. Anyone in your party can be included in that, as it is common enough for thieves to hide shoplifted merchandise on children. Why would you think they couldn't stop you? If they weren't allowed to stop you, how would they prevent going broke from theft?

My uncle named 3 beneficiaries and 3 heirs in his will. One of the heirs is the Executor. My uncle passed away in nearly 2 years ago. His medical bills, funeral expenses and any other outstanding obligations have been paid and his home has been sold. These were the only stipulations that had to take place before any disbursement of his will could be made. All of these things were taken care of before October 2011. One of the heirs (a cousin) called me and told me that the attorney for the estate would not speak with her and told her to contact the Executor, which did not speak to her either, hence, her reason for phoning me. She had MANY questions concerning the will and I answered her questions the best I could. She told me that several dates had been set up to meet with the Executor to distribute the will, but something always came up and the meetings never happened. The last meeting was scheduled for January, I found out this information through a very nasty letter from the attorney for the estate, in which he said that I had caused confusion and doubt about the will by answering questions for my cousin. He also said that I had "targeted" him and the Executer with defamation. I only answered questions for my cousin. Anyway, I received another nasty letter from the attorney two weeks ago, informing me that disbursements could not be made in January 2012, because the Government has now gotten involved and it may take another year before any thing could be paid from the will. I believe the attorney is lieing about the government involvement, this came up within 9 days of two of his letters being mailed to me. However, the Executor could go ahead and pay me and my two sisters (beneficiaries) since we have specific bequests in the will. His letter continued to read, however, due to my involvement, by answering questions, the Executor would have to get the OK to pay us, from the other two heirs (my cousins). Does the Executor need an OK from anyone to pay us? Can this attorney continue to write me nasty letters? Can he accuse me of things I haven't done? Can he twist my answers to my cousin's questions to be defamation?

You have posted basically the same question as before. You are abusing the process by trying to get free advice. And it is impossible for any lawyer to assist you without looking at the information.

You were told to hire a lawyer and pay him/her to review your matter. That is what you need to do instead of trying to get specific legal advice here on a public message board.

And if there is a problem. the executor can be held personally liable for making an improper disbursement under the will. However, an executor often may make a preliminary disbursement of specific property provided that there is minimal risk to doing so and there are enough other assets in the estate to satisfy any extra taxes owed, for example.

Tax authorities like the IRS are very slow in giving approval and it is plausible that notice of a problem was just received. However, without looking at the file, I can't say. Nor do I know about the putative defamation claim as I don't know what was said.

Stop wasting time and get to local counsel.

He has been in the federal prison for bank robbery since Feb, 2010 and should be releasd next year 2012. I've had full custody ever since then. When I filed income tax, my refund ($4000) was held back and given to him as back child support. I disputed it wih the child support division. It is on hold now unil we go to court in August, today I was told by my employer my pay will be garnished effective next week for back pay of child support. He has not supported the children since imprisioned. What will happen to that money an the garnishment when we go to court next month, will I get that money back as I am the sole provider of my kids? Will the garnishment stop?

You should go to the self help center at the district court in your jurisdiction (Albq.) and get help filing a motion to change child support - immediately. Bring a copy of your divorce order / child support order and they should be able to help you get on the road to getting this matter addressed immediately. Alternatively, you can hire a lawyer who could also help do this for you.

You can always sue for the debt without foreclosing. That could easily take a year, however. Why don't you just foreclose and sell the property?

If the property is worth more than the balance of the first, then you would get to keep any amount above that sales sum, less costs of the sale. Speak to the debtor to see what they are willing to do to avoid your foreclosing. Once you file for foreclosure, they will probably stop paying the first and the first will then also foreclose.

Any letter you write to the judge will not be read by him. Rather, a copy will be placed in the court file and a copy given to the state attorney and you lawyer if you have one. You are better off having your attorney argue your position for you.

Hello: In our jurisdiction, the Judge probably would read your letter and advise the parties. It is usually done for the purposes of seeking some consideration before sentencing. However, usually when our clients are entering a plea, we already have an agreement with the State Attorney and the Judge just accepts the plea and orders the agreed sentence.

As for the letter admitting guilt...well, it's OK if you're entering a plea of No Contest or guilty. If the case is not settling, but rather, going to a trial, most likely, the jury would never see the letter.

Depending on the value of the accounts and any other assets in her name and not in trust, you will need to either open a probate estate to obtain Letters of Office or have a small estate affidavit prepared to have the accounts distributed to her beneficiaries.

How her assets are distributed will depend on whether she had a Will (likely since she had a trust) and who the beneficiary(ies) were as stated in her Will (likely his trust).

First you need to ascertain for certain whether the banks accounts were and are titled in the trust or not. A trust will only avoid probate if it is properly funded. If bank accounts are in fact not in trust, then you need to determine the aggregate value of those accounts or other assets not in trust. If those are under $100,000 then you should consider using a small estate affidavit in lieu of probate. If over $100,000 then probate is necessary. Letters of office is the document the executor receives after going to court to open a probate estate.

My son's mom, which is my ex is currently in a relationship with a girl who is making it impossible for us to co-parent as adults and trying to get me out the picture completely. She continues to harass and send me threatens of not "allowing" me to see my son until our court date as well as filing a restraining order on me for no reason. Whatever you are trying to do STOP. You cannot use a UCC-1 to accomplish this. By your post, it is obvious that you have been accessing junk pseudo-law from the internet or other sources. I have seen all kinds of permutations of it - this is put out by nutcases who claim they are "sovereign citizens" and don't have to pay taxes. These are the same people who file frivolous liens against judges, sheriffs and other government officials (now a crime in Georgia).

You cannot discharge debts this way legally other than by paying in full, filing bankruptcy or settling. If you are interested in settling debts in a non-bankruptcy, not litigation context, I can help with that for a reasonable fee.
