Question

My Brother-in-Law has been charge with assault in the 3rd degree and endangering the welfare of a child. My child is 3. What punishment is he likely to see?

Answer

Each charge is a class A misdemeanor. The maximum exposure on each is one year in jail and/or $1000 fine. Instead of jail he could get 3 years probation or a conditional discharge.

Answer

Too many variables to answer that question. What was the injury? Does he have a prior record? Can he claim it was an accident? In what county is it pending?
