In a divorce, does both parties have to sign the divorce decree for the divorce to be final?

Question

In a divorce, does both parties have to sign the divorce decree for the divorce to be final?

Answer

No.

Answer

The divorce decree is only final 30 days after the JUDGE signs it. This is true even if neither party signed it. It may not be true if either party filed motions within the 30 days.

Typically, a judge will not enter an order without both parties agreement if the responding party filed an answer and has followed all of the court rules.

If the respondent did not answer, then the judge can sign a default order without his or her signature. If you are unsure of what has happened, contact a family law attorney.
