How do I find out if a specific case is still open? If money is owed to a person and they die does the money go to the state? or to a designee power of attorney?



Answer

If you have the case number you might be able to find it on the county court's web site; yo can go down to the court and look up the file number and look at the file, even if it is closed. The death of a creditor means the money owed goes into that person's estate and is distributed as the estate instructions state. The money goes to [escheats] to the state only if there are no heirs. All powers of attorney automatically are cancelled when the person dies.
