My ex husband has custodial custody of my kids. They are both living with me now. Can I get child support from him?



Answer

You have to go back to court to request that the child custody order be modified to match the actual custody arrangement now. In that same motion you can ask, and it would be totally normal to ask, that child support be established based on the new custody order.

Take action on returning to court to establsh an order that you have the children and request support. If you ex has a change of heart, he currently has orders establshing the children should be with him. Those orders can be enforced with police assistance.
