Is it legal for a healthcare company to not pay overtime pay for hours over 40 hrs per week?

Question

Is it legal for a healthcare company to not pay overtime pay for hours over 40 hrs per week?

Answer

It depends. Unless the employee is exempt, according to the Fair Labor Standards Act, employees must receive overtime for hours worked over a 40 hour workweek.

A listing of exempt employees can be found here: http://www.dol.gov/elaws/esa/flsa/screen75.asp

If you believe you are not exempt, or are not sure, I urge you to contact an attorney who practices employment law.
