(which was June) But, we agreed I would pick them up July 1st (today), but out of the blue because they were mad, they said they never agreed to visitation in July, and would not allow me to pick them up. I pay $400.00 a month child support, and I maybe see them twice a year because their dad and his ex-wife make it so difficult ( they are back together ) What should I do??

Unless she paid you rent or otherwise compensated you for living there, she has no rights. If she did contribute to rent or compensate you for living there then she most likely has the rights of a sub-tenant, meaning you would effectively be her landlord and would have to give her appropriate notice, etc. However as between her and your landlord, once your tenancy ends, so does her's even if she has acquired sub-tenant rights as between you and her.

I was very scared my status was going to be affected, but after visiting a first attorney, she told me that as long as i remain in my F-1 status, i am fine. She also said that i will only have problems if i go out of status. After surfing and finding out a couple of related issues, i see almost the same problems like mine. Currently, i wish to return back to my F-1 status, but a little scared that the immigration office will sent me a notice of deportation. I have even booked a second appointment with another attorney just to clarify my worries. What should i do next?

It's only a guess, but I'd say that if you meet the other requirements including use in interstate commerce, that the USPTO would grant the trademark. Your risk is the application fee and a perhaps greater risk of being accused of infringing someone else's mark if you continued to use it after being rejected. My one uncle has power of attny over everything. And i know his excuse is, hey "we are paying family (his kids) to take care of her, and that is much less if we paid a Professional", hence extending her time she has money to live on her own and not in a home. I feel so bad for my grandmother, i dont live close and only the vultures live near and are taking over. They have been for years. She is old and doesn't need the stress of family fights, it is a sad and common story. I know what is going on is to an extend unethical because this uncle has a history of shady actions. Your uncle has a fiduciary duty to use your grandmother's assets strictly for her benefit. The problem is that the power of attorney probably gives him wide latitude on how to do this. As long as he has your grandmother's trust, it will be extremely difficult to get in his way unless she has dementia and is therefore unable to make an informed decision. It's possible for someone else in the family to file a petition for guardianship over your grandmother's assets which, if successful, would supersede the power of attorney. But this is complicated and expensive court procedure and would require you to get statements from 2 health care providers familiar with her that verify that she is unable to take care of her own affairs just for starters.

The new owner purchased the rights and obligations of the old owner. So just as they bought the property subject to the lease you had with the old owner, they old got the right of possession the old owner got as to you. You can not expect that they take on only debts and obligations to you and that you are freed of any debts owed the prior owner. They probably did not lie to anyone to get the writ of possession, most likely they said they were the new owner. Even if you could show they lied, since they legally could have gotten the writ, what damages have you suffered?

I'm sorry if this sounds harsh, but be a father and simply do not allow minors to drink in your home. This isn't about reducing your potential legal "exposure," this is about keeping children alive. Underage drinking is just not acceptable, and you need to be her parent and make sure that it does not happen in your home. You cannot control what children do all of the time, but certainly while she is living under your roof, then make it not happen. Regardless of whether she is a tenant or not, she is your minor child and you can tell her what to do. If she refuses, evict them both. You do not want to be responsible for one or more children being killed because of underage drinking at your home that leads to an accident. Again, sorry for the harsh tone of this response, but come on, you read the news about teenagers killed every single day as a result of drunk driving or accidental overdose. Step up and put a stop to it before it is too late. If you don't believe me, go talk to the parent of a child killed in a drunk driving accident. You've never seen pain until you've met someone whose child was taken by something as stupid as underage drinking.

He is considered an adult at 17 in Texas for criminal law purposes. Burglary of a habitation is a second degree felony with a punishment range of 2-20 years in prison. You should consider trying to hire a lawyer for your son if you can. If the facts are as you suggest, there may be some legal issues that an attorney may be able to clear up.

Yesterday I was being followed on a 4 lane rd. by my house by a local police officer. I needed to switch from the right lane to the left lane as the left lane ended ahead. I put on my signal and got over. The officer followed. He then pulled me over. He said that the department received a complaint about me earlier (when I was on the highway) that I had been driving "Recklessly." First off just let me say that this could have been filed by anyone with a grudge against me. There were no witnesses to this alleged driving. So he tells me that and then says that he is just going to run my license and he will be right back (never telling me why the reason was that he pulled me over). 5 minutes later he comes back and says (and I do have this entire thing captured on my cell phone video) "I forgot to tell you why I originally pulled you over. You failed to use your turn signal properly." I asked him what he meant that I had used my turn signal. He says "It's a little known law that you must signal 100 yards before you intend to switch lanes. You signaled, but not far enough ahead. Normally this would not be a problem and I would not pull you over or give you a ticket, but since someone complained about you, I wrote you a ticket. We have to get you driving safe." He then went on to tell me that turn signals are his biggest pet peeve and again he said that if I had not had some random person complain against me that he would not have wrote me that ticket.

Isn't this some form of bias or discrimination? I feel that instead of being innocent until proven guilty, I was guilty until proven innocent. I did not have the means to prove myself innocent so the officer decided that since somebody (could have been someone with a grudge, someone who just didn't like the way I was driving, or even someone I knew just messing with me not expecting me to actually get a ticket) that he deemed me a bad driver and was going to find something to give me a ticket for regardless. Do I have any legal ground to stand on with that video? I mean he does admit that A. it is his pet peeve, B. that he would not have pulled me over if that complaint had not come in, or C. that this normally would not have been a problem, and that the only reason I got a ticket (for something completely unrelated) was because there was a random complaint earlier.

I DO NOT have 149 dollars to pay this ticket! And I really feel that this officer was in the wrong, that he acted as judge, jury, and executioner of a situation he knew nothing about. He has no idea that I have this video. What should I do? I really need some legal advice here!!

Appear in court on the date provided. You might have an opportunity to speak with the prosecutor that day to resolve this. If not, enter a plea of "not guilty" and get your next court date to meet with the prosecutor. Either way, when you speak with the prosecutor, explain to him the situation. Show him the video and request that the charge be dismissed.

If he will not agree to that, provide him with a letter requesting the dispatch recordings for the date in question. Particularly for the times that you were driving on the road. If someone really did call in to report you, it will be on the call log. Once you have that information, and especially if there is NOT a call on you, you can defend yourself.

Also, take a look at Ohio Revised Code, section 4513.261 Directional Signals. There is NOTHING in the law about a 100 yard rule. That is just a recommendation from the department of Safety.

The problems are: I was not inactive after April 6, actually accessed the airport several times with government issued badges after I left (shouldnt have been active), never had access to do payroll (never sent in time sheet after I left), and received a overpayment notice from HR Payroll dept stating I owe $6,734. I have emails and company items (including a AMEX, badges, and company phone that were never retrieved) that are proof to mischief in this ordeal. I believe not only should I not have to pay this money (I was told to stay active), but also I should be compenstated for not receiving the job I accepted and being wrongfully deactivated (was previously told by management that 2 wks notice was resended). I believe I have a strong case due to the fact that I was not ever compensated, and allowing a person to knowingly have access to airport restricted areas without actually being a active employee are serious violations (by FAA and the city government). I would definitely like to move forward with this and believe I have a case at least for my own employement. Do I have a case?

My physical therapist on the first visit told me to see an orthopedic surgeon because there was curvature in my back. I went to an orthopedic surgeon to find out my pain was caused by scoliosis and that it would have to be operated on immediately. I had two curves; one 58 degrees and the other 28. During these four months where my scoliosis had become very severe i had seen my chiropractor twice a month, who never said anything. If this was caught in time, my scoliosis could have been prevented from worsening and i would not have had to undergo a major surgery followed by months of rehabilitation. Is there any legal action i can take towards either my physician or chiropractor for not diagnosing my scoliosis?

The Real Estate Agent told her about the lien four days before closing. She called the credit card company, but they could not give her any information. She would have to wait 3-5 days for a "special team" to call her. They would not give her any information or even a name or number to call. They said she just has to wait until they call her, meanwhile she has less then 3 weeks to get a letter from the creditors stating that the debt was settled otherwise the creditor will be paid out again on this debt. What can she do to get the information from the creditor and what will happen to her money if the creditor gets paid out a second time? Is there still a chance to get her money if the lien is paid out?

My divorce decree states that the child support is an obligation of my estate if I should die, and I have set up my son as the beneficiary of half of my life insurance policy, which should cover a "lion's share" of a lump sum payment of child support.

The question is, if I should die before my son is 18/graduated, and the life insurance disburses to him, but since he is underage, then the monies will go to his mother, my ex-wife. In Texas Divorce Law, would that disbursement be considered a "gift", and *NOT* a lump sum partial-payment of child support upon my death?

Should I take my son off as a beneficiary of my life insurance, and designate in my will that my executor is the sole beneficiary of my life insurance, and that an agreed-upon lump sum from my estate will cover the owed child support?

Number one: If your son is a minor when you die, the monies do NOT automatically go to his mother.

Number two: Proceeds of life insurance are a non-testamentary asset. This means that life insurance proceeds are paid according to your designation that's on file with an insurance company; your testamentary assets pass in accordance with your will. It's two different things.

Talk to your insurance guy. You should be able to make the life insurance proceeds payable to a trust for the benefit of your son if he's still underage when you die. The trustee pays the money to Mom each month in the same amount as the ordered child support. When the child turns 18 (or finishes high school), he gets the remaining balance.

Your question as posted is a bit confusing, but there is language you should include in a will regarding the exclusion of joint bank accounts.

Miswording of a will can increase probate costs or even invalidate a will, so spend a few dollars to have a lawyer prepare a proper will, and also advise you of all the related things you can or should do.

There are things like life insurance and pension benefits which are beneficiary designated assets rather than probate assets. Thus, these will pass to the designated beneficiary named on the forms, not the person named in the will if it is different. As to whether these need listed or not, it depends. Maybe you want the beneficiary to know about it and you could say "I have made provision for X outside of my will." You could also specifically list these things if you wished to do so, but it is not necessary.

Joint bank accounts are similar in that the survivor on the joint account will get the money (check with the bank to make sure that it is set up as a joint account with right of survivorship). They are also non-probate assets.

Since I don't know what assets you have and what are your testamentary wishes, I would encourage you to see an estate planning lawyer in your county. Maybe a will would suffice or maybe you should consider a trust. In either case, the lawyer will be able to ensure that either instrument is correctly drafted to address the disposition of your assets.

Answer

The landlord and the tenant both have the responsibility of maintaining the premises in a habitable condition. If you did not notify the landlord at the time when you failed to pay rent of the roach problem as the reason for withholding the rent, then the landlord cannot know about it. Since you continued to live at the location, apparently the roaches didn't make it completely uninhabitable and likely it will be found that you were required to have paid at least a reasonable portion of the rent.

We had a police officer who fraudulently placed orders with us. We shipped and billed his police dept as instructed. Months later, the Chief sent us an affadavit that none of the orders were for the police dept - but for the officer's personal business. The officer has not paid for everything and this news now changes the orders taxable status. He claims we "misunderstood" when taking his order and has sent us an unsigned resale certificate for his business. Upon further research, govt records show his resale cert expired in 2006 and was not valid again until July 2011. His orders were placed in Dec 2010, & March and April 2011. Besides placing him with a collection agency for the unpaid portion (and tax we now have to pay)...can he be reported for supplying us with an invalid resale certificate?

I think he's committed fraud. I'd write a letter to the chief of police telling exactly what this cop did to you.

It starts the day after the first publication. The 14th would be day number one, and so on.

For one it will pull to much power through the wires and prob hurt your stereo, secondly it would be pointless because theres not enough power to allow the subwoofer do what it was intended to do! His shrubs can't come onto your property however. It's known as trespass. In Washington there are some fun legal screws that can sometimes be used regarding trespass. Just talk to your neighbor like an adult is probably the most appropriate solution is my guess.

Judges cannot have any matter under submission for more than 90 days. Their is a form they fill out to get paid, in which they state whether or not they have had any matters under submission for more than 90 days. I don't think a default judgment package that you deliver to the court qualifies under this, but have not researched it anytime recently.

The time period you are waiting is normal. A lot of court services are limited right now due to budget constraints, and the judges and court staff who are present are incredibly overloaded. You should be patient, as law involves issues of due process, and is not a vending machine.
