If someone willingly deposits money from their own bank account to a company bank account under possible false pretense because the person was trying to supposedly help their roommate keep their job instead of getting fired, and the company owner(s) is also aware that it is not their money, however, when I discussed the issue with both co-owners (married) they both said that I should have called them first to authorize any transaction of this sort (the problem was caused by a very rushed situation and I didn't have time to think the issue through completely; acted out of impulse first) and that they didn't have the "money" (my money) to give back to me. If it wasn't theirs to begin with, and was fraudently put in their account because the roommate lied about the reason of needing the money, then who can charges be brought against? the roommate or the company owner (who both have a history of taking money from people)?

Assuming that you foolishly made the referenced deposit into this company's operating account and without their permission to, perhaps, cover the wrongdoing of your roommate and co-worker, the company may consider your deposit apparently made in behalf of your felonious roommate as coming from him to make amends for funds which he apparently had previously stolen from them.
No, if I were you, I would not expect to see the return of these funds anytime soon.

No. After 21 days. You file the important 10 notice. If after 30 days you can file for a default judgement. The other thinks you have to file for is the rent the tenant is paying to the prothonotary. If she missed a payment then you can terminate her right to stay in the residence.
FYI If you draw up your lease properly you could have made her liable for your attorneys fees. Even if you can attorneys fees are a deductible business expense.

OK, since you don't understand the clear responses you received and don't like the easy solution, and you are asking for legal information, hire a lawyer to file a case in Superior Court to try to require that the church mark through your name in the record book and take you off the email and newsletter list. That is a complicated case, so expect to spend thousands of dollars on legal fees and expenses before a Judge dismisses the case as frivolous. Or, you can just stop going to the church and move on with your life at a new church. Posting here over and over won't change the response.

You should check the laws of the state where the subpoena was issued. In Texas, a subpoena isn't good past a distance of 150 miles. In other words, you can't be compelled to travel 800 miles to come to a court hearing.

Actually, you can be subpoenaed to come to Texas even from another state. However, the prosecutors would have to file a special application and get a court order (as I recall) and make arrangements for your expenses. These expenses would not be paid until after the case finished and you submitted all your proof of expenses.
If you just receive a "regular" subpoena in the mail from a Texas prosecutor, then it is not legitimate.

On March 8, 2012 my sister and I, who she is born in Italy and she is citizen, we came in America.
On July 16, 2012 we both applied for I-130, that have been approved.
For some reason, my sister could apply for I-485, instead of my that they said I have to wait for bulletin visa.
Why there is this difference?

You would need to look on the I-130 approval notices to see which family based category you both have been designated under. There must be some reason that her priority date is current & yours is not. Without reviewing your documents, I cannot tell you why your sister is eligible to adjust and you are not. It has nothing to do with the fact that she is an Italian citizen.
If your visa expires before you are eligible to apply for adjustment, then you must either leave the country or find another non-immigrant visa category to change to before your current visa expires.
You should have an experienced immigration attorney review your documents in order to obtain a more precise legal opinion for your situation.

First off there is a radio wiring diagram for a 1972 super beetle found here basically the exact same as the 1971:
You go under the hood (which is actually where the spare tire goes in the front of our 1972 super beetle). Im taking out an old Kenwood Radio which was compatible with the 1972 super beetle (that's what im working on, but i understand the question here is about a 1971, however they are relatively the same). If you take it out to install a new radio youll need to remove the face plate in the car and modify it with a rotary tool (shave of the existing face to create a standard face that a modern radio/CD player will fit into). also there are little metal markers to keep the old radio in, youll need to bend those off or shave them off to fit a modern radio in the dash.
after this, make sure your new CD player or radio uses14 volt DC power consumption. anything more can mess with alternator power.
use a power amp conditioner directly connected to the batery on a toggle switch or use another 12 volt battery if needed to have extra amps to feed a radio. Know that your bugs alternator may not charge two 12 volt batteries properly however. it depends on if the batteries are hooked up in parallel or in a series. i believe series is the way it will charge properly on a 1971 bug but ideally youd want to run the batteries in parallel for more amps. this might require a better alternator which youll need to shop around for.

I assume this is a normal condo, and not a hotel/motel type place. If so,
They cannot forcibly remove you without a court order. To get the order, they first need to give you a letter demanding you to leave in 3 days. If you don't then they need to file a tenant eviction with the court. Once they get the order, which requires a hearing if you file an answer (which you should do), they have to post a 24 hour notice called a Writ of Possession on your door to vacate, and if you don't, then the police/sheriff can remove you.
Tenant evictions, depending upon where you live take 3 to 8 weeks (usually longer then shorter) normally.
If you stay beyond the first notice to leave, the landlord can charge you double rent and get a judgment against you for any unpaid rent. But you may find that you could stay in the place up to 2 months (maybe longer), though the legal issues/judgment may haunt you.

You'll find precious little in the statutes. The law is primarily non-statutory, judge-made, case law.
An action for harm done by a tree on adjoining property could be brought either as one for trespass, or for private nuisance, or both.

Ownership of trees is covered by CC sections 833 and 834. There are sections dealing with trespass TO trees, but the issue here is trespass BY trees.
Turning from statutes to case law, we find numerous cases detailing the relative rights of tree owners and neighbors affected by invasive roots, overhanging limbs, blowing leaves, and so on.
Without knowing the mechanism by which the cottonwood is causing damage, I'm somewhat inhibited in giving you case law references or guessing whether a suit for trespass or for private nuisance might be successful. If roots and/or limbs are invading your property, you'd probably have the right to cut them at the property line. If it's just blowing leaves, you may have a tougher time; courts are less willing to require a tree be cut down just because its falling leaves make a mess on the neighbor's yard.
I am somewhat inclined to think you may be right and the HOA wrong here, but more facts would be necessary in order to look at decided cases and figure how a court might rule on this. The answer almost certainly isn't in the codes, however.

It is not clear if this is a trust or Will situation. In any case, you need to file a petition with the court to probate the estate or to enforce the trust, probably to remove the current trustee if he/she will not act, etc. The filing fee will be about $365 and you may have to have the new trustee post a bond. if the current trustee will not act, you will likely need to hire an attorney to try to remove that person. Without a lot more information, none of us can stay how many hours that might take and so what you cost would be.

The landlord is responsible for trying to eliminate the infestation and can n ot raise the rent, especially when you did not create the problem. You can withhold up to one month's rent to try to resolve a problem.. With his attitude, I would suggest you try to figure out how long it will take you to find a new place to live, add a little time to that period and give him notice that he has caused a "constructive eviction" of you by allowing a health problem to become very serious and make the unit unlivable and you will move out as soon as you can but by no later than X date, point out he has breached the warranty of habitability also, and that you will deduct the cost of getting rid of the bugs up to the amount of the next month's rent unless he does so within the next three days [the cost of fumigation should be wel under a month's rent; check to see if your neighbors have the same problem so everyone can chip in together to reduce the per person cost maybe].

You may want to look online at the U.S. passport application, but I don't recall anyone being divorced needing to give their FORMER spouse's DOB and place of birth in order to get the passport. If the car is in your name, then you are liable for this debt. No judge can transfer the debt into your name. So you owe this debt.
I would not want her to be given a car that I still owed the debt on. But that is me. I would also want to make sure that the car was totally insured in the meantime in case it was in an accident or stolen.
If that leaves her without a vehicle, I would be nice and find her a really nice used (cheap) vehicle that is safe and reliable and buy it and put it in her name and give it to her. BUT only AFTER the consultation with your attorney. Don't expect her to be appreciative. But at least she would have a vehicle to drive after the divorce.

ACOEM Guidelines state FIRST try epidurals, if those dont work, then surgery.
If your lawyer goes to an Expedited Hearing on the spinal surgery request, most WCAB Judges just follow whatever report quotes the ACOEM Guidelines.
SOLUTION: YOUR SURGEON needs to "appeal" the 'non=certification" (refusal) of his request for a surgery with A SUPPLEMENTAL REPORT.
Tell your surgeon to write a Supplement Report outlining many reasons WHY THE ACOEM GUIDELINES DO NOT APPLY TO THIS PARTICULAR SITUATION (such as, awaiting the recovery from epidural will further deteriorate the remaining disc material, the nerve root impingment will advance to nerve damage in the months it takes to complete epidurals, you're allergic to the compounds in the epidural steroid compounds, etc).
The Labor Code specifically requires the judges to follow the ACOEM Guidelines unless given "good cause" not to do so. If your surgeon / Treating PHysician doesn't write a report for trial explaining to the judge why the ACOEM Guides shouldn't apply here, you'll have to go through the epidural process first.
Get a CERTIFIED SPECIALIST ATTORNEY in Fresno; certified specialists pass an extra bar exam just in workers comp and they complete continuing education, and they cost exactly the same as other non-specialist attorneys.
I've appeared in Fresno and the judges there are very patient and willing to consider a REASONABLE argument as to why they should order a procedure outside the ACOEM Guidelins... all that I spoke with there really wanted to get the injured worker real treatment.
But the judges can't order something just because a doctor suggests it; the doctor must actually explain why -- in your case -- the judge must not follow the ACOEM Guidelines.
Print this out and take it to your surgeon and see if he's able (and willing) to write such a supplemental report... it's twice the work of a regular report and he might not get paid for it, so don't be surprised if he says no thanks (doctors don't like to work for free).

The bigger question is who currently as title to the house. The person who has title is the person who must start the eviction proceeding. If title to the house is still in your grandmother's name, then figuring out who should start the eviction proceeding could be difficult. It may be that you also need to take steps to clarify the title, such as a probate proceeding.
In any event, you should talk to a lawyer and discuss this matter in detail as soon as possible, so as to protect your grandmother's house.

If your grandmother died leaving a house in her name was her estate ever submitted to the Probate Court for administration and distribution in Orange County? Did your Grandmother leave a will or trust document? If no court administration took place the house is probably still in grandmother's name and you have no standing to do anything. If no probate was started you need to retain an attorney to file for probate so that someone can take charge of your grandmothers house and assets. You also need to consider who has standing to do this. Grandmother's living children are first in line to petition the court (I assume grandmother's husband is dead). If there are no living children or they do not want to take charge then grandchildren are next in line to take charge. There are too many unanswered questions to give you a definate answer to your questions. My father bought me a 1999 GMC Yukon SLT in October of 2009. I decided to do some work to it, there was a two-tone paint job from factory. The truck was rusting on the bottom half. I SLOWLY did the body work as i was 16 and had a small job, big expensive gas-guzzling truck, and high school. He stepped in and helped me, because "i was trying to better myself, and he respects that". not only financially but with the work also. He owns a small repair shop in Hobart, In. So he was alot more knowing of how to do it. We decided to paint the bottom half, with the matched black upper GM paint. We could not get the paint line to blend and told with the new basecoat clearcoat paint used today that we never could, especially black. We were told the entire truck needed to be painted. I was more than willing, happy with the way she was as he forked out way too much money for me and i felt terrible. he was 63 at the time and raising my niece, and a whole lot more. He was overly overworked.
My father bought me another vehicle for the time being, and sent my truck to a well recommended, private auto painter. The guy randomly came into our shop needed work done to his outboard motors. Overheard talk about the truck, said he was a painter. My fathers friends at K&K auto, who sells body panels and other parts said he did good work. he is also employed by the city of highland. My fathers niece's spouse works with the guy and also recommended. He was supposedly one who got it, got it done, an back home.
They worked out a deal, for work, of work.
we did and returned his motors. he recieved my baby. at first it was at my fathers friends, sons garage. as he did not have place for it.

He was not able to do so so they worked out a deal to pay the probation dept. $50/month. Probation ends in a few months and he's wondering if they will try to collect the full amount or dismiss it after then. Doesn't it seem odd to have to pay when the original stolen merch was returned unharmed?

If the physician group wanted to employ you, it could, but you would then most likely be terminated by the hospital. My guess is that the physician group will not want to consider employing you given the hospital's position. I don't see any legal recourse against the hospital, but you should consult with other counsel to see what others say.

The will distributes property when it is probated. The house belongs to the beneficiaries. So do the contract rights and duties.
The probate code also establishes a probate homestead for certain relatives who were residing in the home such as a spouse or child.
You are going to need an attorney to probate the will. Suggest you hire an attorney in your area to do this and advise you on the contract.

Wells may freeze that account, so better to move it, and ideally not put your name on the new account elsewhere, but disclose what you did in your petition. If it is truly his money, then in Va the trustee has no claim to it.
Tax refunds are like any other money, and if you are subject to Va exemptions, you have to use the so-called homestead for that.

This is a rather major decision, and I would advise doing some research and planning before just cutting and running.
First, you don't say whether, nor how far, "under water" you are with your two loans, Real estate prices have perked up here and there in California....I am trustee for a home that has increased in value by 20% since November, 2012. Try to get a current valuation and try to project how long the recovery would have to continue before you could sell and break even, or better. Obviously, some communities will recover a lot more slowly, but check it out.
Next, I think the main danger of walking away from a property with two loans is that the holder of the first will foreclose first, leaving the holder of the second without collateral. It becomes what's called a "sold-out junior" lender, and as such can sue you. That's different from the situation with a lender that has a good deed of trust, which is limited to foreclosure as its remedy.
If you abandon a property, and something happens to it before a foreclosure, the lender(s) could sue you for "waste," alleging that you failed to maintain and protect their collateral, as you agreed to do when you borrowed. This is uncommon, but it can happen. Maybe you can find a tenant who would care for the property responsibly and pay enough rent to cover the loan payments until values recover. Maybe a local income-property-management firm can give you some tips.
Maybe the lender(s) could give you some relief, such as a loan modification, consolidation, or a short sale. Marginally better than just defaulting.
Finally, if you walk away, or allow a foreclosure without walking away, there will be fairly serious credit consequences which will follow you for years, wherever you go.

No, the rule is a little more complicated than that. The rule only applies to meeting the minimum wage requirement. It states that they cannot take a credit against their minimum wage obligation of more than 2/3 of the fair rental value, to a maximum amount of $451.89/month for a single manager, $668.46 if both members of a couple are employed in the management of the complex. So what they pay you in cash each month, if anything, plus $451.89, divided by the number of hours you work in a month, must add up to $8/hr or more. So what the limit really means is that if they are paying you in rent credit alone, they cannot work you more than 56.5 hours a month (assuming you do not work any overtime). If they pay you any cash, then that would be added. So, for example, if they give you a rent credit plus $200/month, then they could work you 81.5 hours a month (again assuming no overtime). Bottom line: it is not a limit on how much rent discount they can give you, it is a limit on how much of that discount can be applied to meeting the minimum wage law.

Warning! This part drives your oil pump! DO NOT USE THE DORMAN PART! The Dorman part is poorly manufactured and WILL fail . Use a Genuine Motorcraft or A1Cardone Syncronizer (or sensor). Depending on which you are replacing.

The cam synchronizer is a common failure item in Vulcans, with a working life typically between 80-100k miles. It usually doesn't seem to do any damage if caught in time, but as the gear at the bottom of the synchronizer drives the oil pump it could (worst case scenario) theoretically destroy an engine.
There are two causes for the failure. The first seems to be exclusive to the hall effect version of the sensor, (up to 1997), where a piece of the magnetic tab that sits on the underside of the top of the sensor breaks off and damages the vane (metal tab that sticks up out of the rotating assembly that the sensor reads) that is used to time the engine; this will throw a CEL as the sensor is no longer functioning. The second applies to all vulcans and is what actually causes the chirping, it seems that the rotating assembly in the synchro does not receive proper lubrication and the bearings start to fail. In either case the synchro itself will have to be replaced, and it's usually a good idea to replace the (cheap) sensor while you're at it.
The problem manifests itself a chirping coming from the transmission (driver) side of the engine. It can be very hard to pinpoint, when mine started to fail the sound appeared to come from different places as I moved around the engine bay. When my mechanic took a stethoscopey thingy to my engine bay, he concluded that it was ghosts and I should "come back if it gets worse". From reading posts on here, and my own experience, the chirping responds to RPMs, most pronounced at idle and eventually drone out to a whine at driving speed. It also seems to be affected by heat and humidity. Mine stopped making noise (when it got cooler outside) the better part of a year before I replaced it, but I suspect that if I hadn't it would have started again when it got hot.
There's a cheap way to replace the assembly, and an expensive way. From what I've read on here, dealers/mechanics will charge $150-$170 for the assembly, as well as 3-4 hours of labor for the replacement. The actual replacement of the part is as simple as undoing 1 clamping bolt, removing the old assembly and installing the new one. The most time consuming part for me was cutting the plastic tray that guided the wire bundle that ran directly overtop of the assembly so that I could even get to the synchro. Whether you are comfortable with doing this yourself will depend on how stubborn you are, and whether you think you're up to digging your way to the sensor/synchro. That's the hard part.
There is some risk to doing it yourself, but only if you do it incorrectly. The cam synchronizer is integral to engine timing, and if the new assembly is not installed with the exact same orientation as the original some serious damage could occur. Luckily, it's not that easy to mess up if you pay attention. The teeth on the bottom of the synchronizer are big enough that the vane rotates approx 10 degrees for each tooth. After removing the sensor from the top of the assembly and before touching the clamping nut that secures the synchro; if you mark the relative position of the synchronizer body on the block, and mark the position of the vane on the synchro body you can install the new synchro in the exact same position. If you make accurate marks and pay attention, it will be obvious if you are off. I replaced mine with this method and have driven approx 150 miles since without a CEL to be seen, nor a squeak to be heard.
Good luck, I saved myself several hundred dollars doing this myself with information gleaned from the TCCA. Even if you choose to have a mechanic or dealer do the replacement, diagnosis and correction of this issue could save you some money and trouble in the long run.

Locate the cam synchronizer there should be a small coolant hose above the harness disconnect the hose pull the spark plug wires from the coil move them out of your way lift up on the wiring harness shroud there are two 5.5 mm bolts holding the sensor to the synchronizer remove the bolts remove the sensor mark the location of the synchronizer on the block and there is a tit inside the synchronizer mark its location to the synchronizer body now remove the 10mm bolt holding the synchronizer to the engine pullup twist counter clockwise it should come right out then get your new synchronizer make the same alignment marks on the new one as you marked on the old one and slide your synchronizer in the hole make sure all your marks line up then do the removal steps in reverse.
To replace the Sensor:(Do this if your computer throws a code (Check Engine Light) in reference to the Camshaft Position Sensor [CMP])

Replace the 5.5mm bolts and bolt it in being careful not to overtighten. Plug back in the wiring harness and replace all displaced hoses and fasteners.
Warning: DO NOT USE the DORMAN Camshaft Syncronizer or Sensor.
The Dorman part has had numerous failures in other Tauruses. If the CMP fails in this engine, it will STOP the oil pump. This is dangerous as lack of lubrication will not be evident until the engine has seized. The Taurus does not have a low oil pressure light which would warn you to the event.

I installed 3 new Dorman(CHINESE) syncro units back the 2nd week of October (2) #689-104 (1996-1997 3.0L Vulcan) and (1) #689-107 (this was for a 98 3.0L Vulcan) . I put one in my brothers 97 GL, 1 in my mother-in-laws 97GL an the other into my mothers 98 SE.
The reason I went a head and changed these 3 is in a thread I made about my wifes GL.
Fast forward to last night, my brother said his car was leaking oil horribly. I checked it out and it was coming out of the sensor on top the new syncro. When I pulled the sensor off it was completely full of oil. I yanked the syncro unit out and I was totally Horrified. The roll pin in the gear was split in half and falling out of the gear and the gear was loose on the shaft....this is a press fit application(supposed to be). It also wore the thrust washer on top the gear. JUNKED! 2500 miles. I was fortunate it did not grenade his engine.
So I go pick up the mother-in-laws and pulled it out.....the gear was loose on that one and had play in it also...not totally failed yet but was already stressing the pin horribly and it has oil weeping under the sensor already. JUNK #2. around 1500 miles.
I then go pick up my mothers 98 and you guessed it...the freaking pin and gear are loose here also...JUNK.
These units WILL FAIL! I fortunately had all the old units lying on a shelf and put them back in till my Reman units(A1 Cardone...USA) come in Monday. The parts house was astonished but not surprised....loose tolerances and sub-standard metallargy.
Do yourself a favor if you are using one remove it and inspect it ASAP! I could understand finding a bad part out of a barrel but all three is a whole other ballgame.
BTW, Im going to pull the Reman-Napa(actually A1 Cardone) out of my wifes tomorrow to see how it looks. I BET it is perfectly fine.

In a nut shell,car tearing up the neighborhood flies into a parking lot avoiding law enforcement,me leaveing at the wrong moment pulled over a few hundred feet down the road and issued a reckless driving citation and on the citation vehical is documented as blue in which the vehical tearing around was light blue or silver in the dark and my vehical is still fire engine red with a 8 year old paint job.When I am successful with this case i plan to have a counter suit.Understanding i have much more evidence to bring to the plate ,i feel wronged and does a counter suit sound resonable when it possibally costed a job do to this unnessesary court cases.

Unfortunately, once a statute of limitations has expired, the claimant is then barred from seeking redress. The complaint may be dismissed by the court. If a claimant was unable to find a lawyer to represent him/her, it is up tp the claimant to file a claim pro se to preserve the action, if they so choose. Otherwise, the failure to retain a lawyer despite a good faith effort will not preserve the claim.

Presumably he only has to pay back the amount he borrowed that exceeded the loan limit. In this situation, he needs to take the loan papers to be reviewed by an attorney who can advise him if he has a legal basis for enforcing the agreement as it now stands. If he has limited resources, he can go through his county bar association's lawyer referral service to get a very inexpensive consultation.
