We signed our lease on March of 2007 and our rent is due on the end of every month with a 3 day grace period. I feel compelled to write again about this problem. I should have asked more directly in the beginning. The quick background is this; A collection agency has been calling my Mom's house for a couple of years now asking for my brother, who doesn't live there and hasn't for many years. He went bankrupt a few years back but we don't think that has any relevance necessarily if they are calling when they don't have any right to call.

The question is - Do they have a right to call even though they know no one lives there with that name. That is exactly what we say and have said from the start. They might deny it but they know either directly or from the background when they get the case. It's been going on for so long that I'm sure it's been handed off to multiple companies who would have to know.

And do they have a right to use a recorded message, does that get them around that federal law? They have been using and leaving a message for probably a year and they try to be intimidating, saying if anyone continues to listen to the whole message they are acknowledging they are my brother even though it could go directly onto an answering machine.

We'd really like to put an end to this.

I was recently laid off by my employer of the last year. I was an exempt salaried employee but no employment contract was ever signed, so obviously I have the whole fire at will clause working against me. It was obviously a very calculated move on his part: he came in to the work place, told me he was letting me go, and had my last paycheck in hand. Coincidentally, it was also the first day of the new pay period so he had his bases covered there.

It was essentially the finishing blow on what had been a very disappointing couple of months. I had relocated with the company from a city with a very low cost of living to a city of a much higher cost of living. I was verbally promised multiple new benefits.

1) I was promised a 10% profit share from the previous 6 months of operations: Not received

2) I was promised a 10% stake in the company upon my arrival at the new location: Not received

3) I was promised that any and all moving expenses would be covered by the company: Did not happen

4) I was promised a raise: I did receive a raise for about one or two non consecutive pay periods, but nothing consistent.

5) I was also promised a severance package proposal would be emailed to me the night of my termination: Not received

Now I am stuck in a year long lease at a condo that I absolutely cannot afford with no termination clause. It is highly unlikely that I will be able to find a job anytime soon that will cover these costs.

He wants to take 2 out of the 3 kids for visitation (they are 15, 12 and 12) - he has a hard time dealing with 1 of my 12 year olds which he's a very lively boy that's kind of like his momma that's why dad can't cope. I thought visitation was for all the children? How does dad get away with picking and choosing? Also, with the same 12 year old when he does take him he sometimes brings him back early from visits because they are too stressful for dad. My 15 year old is about as big as dad, is a really good kid, good student, and does not deserve this selfish behavior from his father. He has made his desires clear to his father about not just getting to see his friends 2 weekends a month and his father could care less and I guess wants his kid to resent him.

I've already spent $20,000 in modifications which cost more than the divorce and have basically gotten no where because he makes up his own rule book.

Your X is a jerk but he does not even have to visit with any of the kids. He can take 2 of the 3 but if you decided to go back to court, he would look terrible for doing that (although you would probably need to invest in psychological testing, etc., to show damage.)

As far as the older child, unfortunately it is the X's choice on what the kids can and cannot do. You are obligated to send the kids with him whether the kids want to go or not - although as this situation gets worse, my guess is that the older will start to refuse to go. You are still obligated to "make" him go if possible but this is real life . . . .

You should file the action in Conneticut. Conneticut has jurisdiction over the father because he lives there. If you wait until you get to Massachusetts, the court could find there is no jurisidiction over him. This doesn't mean you can't get child support. It means that there will be a different procedure. The Massachusetts Court can start the action and then send it to Conneticut for jurisdiction over the father. This means that Conneticut law will control but it will take much longer to get any child support paid. You could be looking at a delay of 1 to 2 years. Start the action now while you are in Conneticut.

My brother and I moved into first floor apt in August 2013, which was not at all ready to be rented. nothing had been cleaned or repaired (ie soured refrigerator stinks and taints food and infested w/roaches, sinking bathtub w/rusted holes due to 20yr leak, w/bolts popping out and the occasional sewage back-up that filled tub half full and solidified, flies nest still producing flies from somewhere-?-, dead bug carcasses hanging on ceilings esp. over oven which was never cleaned and smokes more than I do, burners that won't work, etc.

I have reported all this to landlord. An apt across hall has opened, he said we could move into once electric was put in our name, it has been in our name for 3 days and he will not give key or answer calls concerning issue.

Since my tenancy began, many repeated calls for police have been made not concerning us. This neighborhood is full of drug dealers and gangsters on porches selling crack and heroine (neighbor that moved from open apt. had been held hostage by gangsters, raped and beaten over halloween night which was on the news.) Last week, brother and I almost had a fight concerning the stress of this move and our living conditions, I called police to keep peace and avoid letting argument get to heated.

Now landlord questions ALL police calls and accused us of all the other police issues that have been made over past 6 mo. I assured him that only that one call had been made by us, and explained why, but he wonders are we gangster related and responsible for activities that we know nothing about.

I and my brother stay in unit and avoid the bad element living near by, we keep to ourselves. But are currently paying electric in both apts. but have not been given keys to move next door and are still living amidst roaches, stink, and soggy sinking bathtub (no exhaust fan, just big dusty hole where one once was) I believe there is much mold formed under sinking tub, which I am very allergic to and am getting sicker by the day.

Our electric bill gets taken out of our name in this apt today, running nicely on our dime next door in apt we cannot get into until he brings keys.

What am I to do? Rent has been paid for January. He has told me we will have one day to move if he ever gives us keys. but has his phone shut off now and will not respond to my calls. I have no idea why he thinks we would be responsible for all police calls or gangster activities, and to be quite honest we are offended by the assumption. He has not questioned other tenants on the matter, even when kidnap/rape incident produced news reports and many following police calls.

My landlord sent me an email to my work email saying that I would be evicted in 3 days for not paying the rent. It also happened to be a 3 day weekend so I didn't read it until it was too late. When I got to my apartment there was a letter on the door that said I was evicted and she had already changed all of the locks. I read online that I could ask for a key to the new locks, but she refused to give me one. She said she wasn't giving my property back and she would see me in court. She did not go through a legal process to evict me. The notice that was on my door was one that she had typed out herself.

What can I do to get my property back? And if she does take me to court will she win the case?

You have been illegally locked out of your property. You should go to the justice of the peace and file a writ of re-entry. If your landlord wants to evict you, she has to go through the eviction process which includes filing a proceeding in court. You are not legally evicted until a judge says you are evicted. Another option is to call the police to see if they will make the landlord let you get your stuff but they may just say it is a civil matter. Find a landlord/tenant lawyer in your area.
