I have a Client who is based in Abu Dhabi (UAE). He is a national of that country and his primary business is there.

He has developed a line of sportswear and is currently creating a retail and online model to sell the products. The business has its own name & brand.

The questions are as follows:

1) The clients wants to register / trademark the brand to be an international trademark, and to be protected in all countries. He wants to register his brand in the US with the global protection - can he do this or should he register in his home country?

2) If yes - how would he do this?

3) If he wants to locate the business in the US, (meaning open stores in the US), is that possible? Can he own the (US) company 100% or does he need a local partner ? In other words what are the foreign ownership rights. He does not wish to live in the US so an EB5 is not a solution.

4) are there advantages for him to register in Nevada or Delware?

In order to give you some direction, I am providing you with some quick answers (I am sure other attorneys might give you a more detailed response). Basically:

1) He should register in the US and his home country, as well as Europe if he is planning to sell there in the future.

2) Consult an Intellectual Property Attorney with knowledge of International Law. (We can provide you with referrals).

3) Yes, he can open stores in the US, an can own 100% of the company (he doesn't need a local partner). We can assist with the tax planning and business entity formation.

4) There could be tax advantages to using a Nevada or Delaware corp, but it would depend partially on where he opened his first stores. The benefit will become more tangible as he has more of an overall US presense.

I agree with Mr. Nazarian in general. I would add on question 1) that there is no such thing as a unified international trademark. Every country has it's own trademark laws and registration (though I think the EU now has a centralized system) So you have to register everywhere you want protection. On question 3) a foreign national and foreign companies can do business in the US without any US ownership and only general registration and local business license requirements. There does not need to be any US ownership or even a US legal entity. Most foreign businesses, however, find it very advantageous to set up a wholely owned US subsidiary to do business here. On 4) there are tax advantages to setting up the subsidiary in Nevada only if that is where you physically do business. Most taxes are based on where the business operates, not where it is incorporated or formed. Delaware has corporate governance and securities laws that are very advantageous to management of publicly traded companies. Unless he intends to issue a public offering of stock, Delaware would be no better than most any state for incorporation.

The advantages of forming a business in a state where it doesn't actually operate significantly are outweighed by the disadvantages, except for large (publicly-traded) corporations. However, I cannot say that California is necessarily better than any other state, and it probably isn't -- a careful review should be done of the LLC, corporation and related taxation laws of several states in which the business plans to operate. Give some consideration to the location of manufacturing, importation, warehousing, employees, etc.

Registration under the Madrid Protocol can protect the brand in a large number of countries and is managed by the World Intellectual Property Organization. Their website has a lot of useful information about this process, fees, etc. As far as bringing your client's stores to the U.S., he should consider franchising as a more efficient and profitable growth strategy. It would eliminate virtually all of the red tape, and shift the financial responsibility for establishing and running stores to franchise owners. Consult with a good business or franchise attorney for specific advice.

The amount at issue matters. Small claims does not take long at all. You have to pay for it though and you have to be able to collect against the former tenant. If the tenant has no assets, then you are not likely to get anything and it will be a waste of time. Speak to an attorney who handles these types of matters first and decide what is best for you.

Anyway, I got the judge to vacate the income execution against me because I had no idea I owed them any money and was never served any summons or income execution. However on my appointed court date, the case was adjourned due to a religious holiday and now I have to go back Nov 7. My question is what documents can I bring showing the judge I am not able to make any payments at the moment if I do owe any money because of my low income and other financial obligations?

If there is no stipulation, you will have a judgment rendered against you.

First of all...when did you incur the obligation? Was it more than 6 years ago? If so, the statute of limitations MAY have run. (they can't sue you for an OLD OLD debt.) Check that.

Second...you need to see the documentation that evidences the debt so you can make sure it was not an error. Errors are made all the time. Did you have loans to cover tuition? Did you leave early in the term so as not to be responsible for ALL the charges? Is it just tuition or did they add other charges like collection fees, late fees, damages to property, etc. How are you to know unless you see what they are using to calculate what you owe?

The court is not going to make you do anything...they are not there to force you to pay their sole function is to determine if you owe the money or not. And Nov 7 is NOT the trial date it is just the date the court will determine IF they will vacate the judgment...They usually do. Do you live in an apartment building? service of summons and complaint in large buildings is spotty. As a matter of fact, service of summons and complaints by certain collection firms has been determined to be fraudulent (the summons and complaints were never served). How old is the judgment?

Don't argue inability to pay...the court doesn't care. Argue that you have NO knowledge of the claim and want to SEE ALL THE DOCUMENTS that the law firm who sued you has in their possession. You are entitled to see everything and anything you signed. Admit NOTHING to the court other than you did go to school but you thought everything was paid because you would have NOT been able to graduate owing $$. Many schools operate that way.

You want the judgment vacated and an opportunity to defend the claim. That's the relief you need. The court will probably give it to you and you will file an ANSWER that says basically that you don't owe the money...they have to prove you do.

Demand the plaintiff provide you with all the information in writing, copies of documents, etc.

Did the debt get sold to another company? Institutions sell debt all the time and if they did, you can demand proof of the sale...Also, if it was sold it means that the school can't or won't provide anyone to testify if the case goes all the way to trial...so there is an incentive for the plaintiff (the entity that is suing you) to settle because without a witness they cannot win at trial.

When you went to school there was a student handbook that basically was the agreement between you and the school...GET A COPY and read about your responsibilities as a student.

Move out all your stuff you don't want want her to take. That only leaves her stuff.

The ticket for domestic violence appears to be just a class C misdemeanor. Set if for trial. Unless there is a witness to the violence, she will have to come to court and testify. If she continues to hit you make a police report. If there are any injuries, even a bruise or if she caused you pain. let the police know. This could send her to jail. Which would give you time to move out. You can also file a theft charge against her for the stuff she took.

I live in Los Angeles and have been renting a two bedroom apartment for a little over a year.

I'm in the process of moving out and my landlord is trying to deduct a cleaning fee from my security deposit. I would be fine with paying this, however, she already charged me a cleaning fee to move into the place.

I also know that she charged the lady that was previously in my apartment a cleaning fee when she moved out. I don't understand why she would have to deep clean the apartment twice.

And I'm pretty certain she is going to charge the new tenant a cleaning fee to move in because that's what she did to the new tenant next door.

If you have paid a security deposit and a cleaning fee on move-in, you probably should not owe a cleaning fee upon move out. I recommend that you review the residential tenant informational materials at the California Department of Consumer Affairs website. Once you move out the landlord has 21 days to provide you with either a full refund or alternative an itemized statement of any deductions that are being made from the security deposit. If you have objections to any charges you should consider trying to take the matter to mediation or alternatively going to Small Claims Court.

As a blackbelt minimum in these atyles i.e shorinjiryu,Brazilian jui jitsu, judo,akido,krav maga and it took 28 year i started shorin at 11. i was funamentally due my blackbelt 16 in that ryu. I styaed till22 where became a 4th dan. Shorin incorporates a hybrid approach due to all the destruction of our tradtional and will be missed stles with cross training. The hombe in Osak,Japan had to adapt a more diverse ryu to compete. So they decided on most call it Brazilian jui jitsu but we was told akijuijitsu. The incorporated a wrestling stylealthought American wrestling is much more proficent but doesnt have the striking, submissions as judo but it's a much better type of grounding and controlling him there. The added akido for a wildcard due to the fact most when encountering a nidan at the most a attack startegy is out of the question u resort to staying away and using a striking style to offset that that's where the karate in Shorin is equivalent to tae kwon do or gojo. You have a minimum of 10 kicks and directions , angles of these,then the hands, elbows,knees are about 3/4 as muai thai. So thenalong with jui jitsu which has as many or more submissions but have not as much submission defense if i guessed i say 80% of Gracie cause no matter what one says gracie is with out a doubt unmatched. I got the permision when i became accepted in the All Nothern japan krate kempo teachers guild to instruct and was a sempai and a 3 year probation sensei till I was requested to be at the hombu in Osaka for the 9th dan master of Shorinji ryu and Grand Master a one and only 10th dan. i had somewhere near 60 kata, had 8 kumite matches without over a 60 sec break between each 3 min round of 3 rounds you have to complete a minimum of 60 of the 120+ kata you practiced. So after 6 hrs of this a 10 page essay onshorin and what addition of Krav maga I incorporated into my dojo effected and if positive how. i was a sandan then aftre the p.test and a 10 page essay and ettiquette observation I was permanetly a sensei and rokudan and awarded a award for adding and afterwards sharing Km there a honor as a martial art visionary. I am no visionary but know martial arts and say the best Bakca Shorinjiryu To. karate,jui-jitsu,judo,akido,krav maga and all incorporate theri own perspectuve kubudo in each so technically 4 of the 5 due jui jitsu has no kubudo we offer. If u attend this stylr and complete the entire course u will have minimumally a black belt in karate,Judo,Akido,Ji-Jitsu and Krav Maga. We are in talks with a sambolegend to think of incorporated this. I have been told advance to 7th dan its my goal. Its rumoured that savate is being seekd out for influential legen to teach. I am sure in 6 to 7 year that's my goal for 8th dan and possibly a direcor's position. So give it a try say 12 year one style has karate,jui jitsu,judo,akido,krav maga, sambo, and savate. You may have a few options. Since you and your step-sibling are not blood related, you may have retained some property rights in your mother's estate at the time of her death. When someone passes their property gets somewhat divided between her surviving spouse and her children that are not of that spouse. Yoru stepsibliongs portion went to their Dad at the tiem of Mom's death. You may be able to file a Petition to Determine Heirship. The time since Mom has passed may make some it dificult.

You said they had a "joint will" but did nto describe wht you meant. If you are saying that they had one will that was to act as the will for both of them. If it said, that you get nothing, then you may get nothing, under the will. But, if they had seperate wills that referred to each other's then you may be able to say that they had contract not to make subsequent wills that differ. If the will say "house A goes to both kids" then his trying to trnasfer ownership of the hosue to one child, may violate that contract. You might get such transfers reversed based upon that.

If your mother's will provided for you, and yrou Step Dad's will allowed him to give away everything, you might be able to have some of the transfers reversed. You might even be able to make aclaim agisnt the attonrey that drafted your mother's will.

These things are very fact dependant. I've tried to highlight some of the p[ossibilities. You need consult directly with a probate attorney in your area soon. Allow them to get all the information you don't have space to provide here. They may be able to advise you as to your options. Don't delay, as some actions have a short time in which they can be done.

If the case was dismissed without prejudice, the creditor or collector may continue to collect or possibly file suit again. If she had done that, the Georgia courts would enforce it and send the child back. By not making it a formal order, however, that agreement isn't worth the paper it's written on. Georgia now has jurisdiction over the child and the case. Everything will be done in Georgia courts according to Georgia law. She better start saving for a Georgia lawyer and travel expenses.

It might help to get a portfolio, or a video of you acting so you could then send it to talent agencies to become more well noticed.

Well he missed one and hasnt paid his fine and more than likely has a bench warrant for his arrest. He has grew up and is no longer the young and disrespectful ignorrant one and has a great job. Your fiancee can simply call the court and ask them how much the fine is and how he can pay. He can also ask if there is bench warrant for his arrest. If so, he should contact a criminal defense attorney in Reno for assistance. If the court sent it to a collection agency, he can contact that company instead.

I'm in Tucson AZ. Two days ago while my 10 year old was on the school bus he let a kid use his phone to call her mom. The gerl misdialed her moms number and when the person on the line answered she said "Don't Bomb Copper Creek" (which is their school). The person called 911 and they traced my sons number to the school. School went on lock down. My son was called into the office were he told police that this girl used his phone. I was not present. He was afraid and told police he didn't hear what she said. When I arrived they had already read my son his rights, which I did not know till later in the day. My son looked scared and looked like he was hiding something. After talking with him in front of police he finally admitted that he did hear her say it. My son didn't want to see this kid get in trouble and didn't want to be the one to get her in trouble, he's only 10... My son was charged with False Information, Class 1 mis and Interfering in Govornment Ivestigation, Class 1 mis... He has been suspended from school for 9 days but we have to go in front of school board and they might not let him back.

My son was a witness to this crime. He did not do this threat. On his school disiplinary action they said "bomb threat" "threats and intimidation" "disruption" "lying to law inforcement" My son is an A & B kid. He has a huge heart and is a protector. Can I get these charges against him dropped? He did not lie, he's a 10 year old who was afraid to get somebody in trouble. Also, on a funny note, his principle told him to lie and just tell kids that the police were there because a pipe broke. And 15 min later he was charged with lying.

If the fuel system has a leak it would be leaking fuel. There should not be air in the fuel system unless the fuel tank is empty.

If you got a code saying that, Your car might have a loose gas cap, the test pump is bad, fuel sending unit gasket or a problem with the tank vent valve(depending on make/model). Car now a days have to have an EVAP system to check that the fuel system isn't leaking fuel vapor into leaking fumes(HCs) into the atmosphere.

I would remove/reinstall the gas cap and clear the fault and rerun the test. If it still is showing a code. Again depending on make/model, there might be a pump self test in the scan tool or you would need a smoke machine to find the leak.
