How often can petitioner file a divorce actionin Florida if the respondent cannot be served?

Question

How often can petitioner file a divorce actionin Florida if the respondent cannot be served?

Answer

There should be no reason to keep re-filing the divorce case. If all efforts to locate the other party have been exhausted, you should be able to get "service by publication", which is accomplished by placing a small ad announcing the divorce action in a newspaper in the county where the action has been filed. Speak to the Clerk for mpore details.

Answer

Summons are good for 120 days. If you need to get an alias summons the cost is approx $10.00 . However Mr. Buckley is correct, if you have exhausted all efforts to locate the other party then file a Notice of Action in the paper. The Clerk of court will tell you which one you need to use.
