i was at work. a guy called got mad and stared cussing me out and calling me everyname in the book i said ''fag'' and hung up now he says ''hate crime'' ive never even met him and now hes trying to blackmail me

Generally, crimes are prosecuted by the government, so unless you are contacted by a police officer or district attorney, then you have little to worry about. However, the other person could seek damages in civil court, but that would be expensive and time consuming. To answer your specific question, yes there a chance of this going to court, but it is probably pretty small.
