My father passed away and I inherited his share of 59 acres in Texas. All relatives involved agreed to sell the property. During the title search, it was determined that there were names on the title of persons that no one remembers and/or long deceased, one as much as 75 years ago. How do we proceed to clear title for sell of the land?



Answer

You will need to track down the heirs of the deceased people who are still in title. You can then use heirship affidavits and deeds to transfer the interest of the heirs' heirs. If not, you will have to argue some other mechanism to extinguish their interests, such as adverse possession.
