Unfortunately, you were obligated under the terms of the mortgage before you filed bankruptcy and remained responsible even afterwards in the sense that the bank can still foreclose your name off the title if your former wife defaults on mortgage obligations. Such an action would list your name on the lawsuit and require you to be served. While all of this is unchanged by bankruptcy, the bank rights which one can change by reaffirming are that it provides the bank with the additional option of pursuing a personal judgment against you (which could theoretically lead to wage garnishments, etc.). Reaffirmation also allows the bank to report the payment record after bankruptcy to the credit bureaus. Personal judgments on residential, owner occupied, first mortgages are rarely pursued by banks in any event, so you may not have much to worry about there. The credit reporting following your wife's reaffirmation can either be a good thing or a bad thing for you, depending upon how well your former wife does on keeping up on the payments. For second mortgages (as well as 3rd, 4th, etc. mortgages), the outcome is very different. Banks nearly always will pursue personal judgments on those, as well as wage garnishments, etc., because most second mortgages are worthless these days for any home which is already close to being upside down on the first mortgage, compared to the home's value. You should probably schedule a consultation with a bankruptcy lawyer to go over all of this. If you want to bring up the forgery issue, you will need to do it soon or "forever hold your peace," as a practical matter. They should have a cancellation policy. If they do not follow it, or refuse the refund, the clerk's fee for filing suit will likely be $300 and the sheriff's fee for service of process is $40. If you want to hire an attorney, you would be very lucky if one will take the case for $500. So, you can see that it may cost more than it is worth to sue the day camp.

No I stated the Fl-306 is a re-issuance. A re-issuance is given if the individual was not served timely. You stated it was a restraining order. There is two types. One is a Domestic Violence Restraining Order under the Domestic Violence Protection Act. The other is a temporary order an FL-305 usually granted via Ex-Parte basis due to some concern regarding the children. Now you are stating it says a Parentage and Support claim which has nothing to do with a restraining order. A parentage claim is an FL-200 which would be followed by a summons as well. Regardless you should have copies of the paperwork which has the FL-306 with it. I would highly suggest you talk to an attorney in your area (Vacaville). No attorney is going to be able to answer your question completely without looking at all the documents.

My wife, 10 month old baby(in a stroller) and myself reached the PATH train station, she held her path card and tapped it and I followed her tapping my card. We did not realize

that her tap had not worked and it was my tap on the reader that actually opened the channel until a cop called me from behind saying that I had not paid the fare. Since there was

rush and the baby in the stroller was fuzzy being his sleep time (around 9 PM) we did not pay attention that we missed out on paying for atleast for one of us.

If at all this happened, it was not intentional, it was circumstantial and happened unknowingly and I had no intentions to evade the fare.

I have been asked to appear at a Criminal court in NY and have been charged with Fare Evasion(6861 sub 4) and trespassing (140.05).

I believe I am not guilty of either of the two offenses.

What should I ask for at my first date at the court ? Can I plea for a dismissal or ACD ?

Will this go into a trial ? and what are my chances of getting this dismissed ?

Are these just violations or will these enter my criminal records.

What is the penalty I am likely to face if convicted ?

I am currently on H1B visa, will this affect my Green Card processing and naturalization thereafter ?

On your fact pattern you committed no crime. It sounds like a malfunction of your wife's card and since your card worked you are not responsible for her card. Unfortunately, with immigration matters you must disclose the summons, even if it is dismissed.

In California, there is a general legal principle that the security follows the loan, so that whoever holds the note is also protected by the deed of trust, irrespective of paperwork faults. This doctrine may have some limits, but its existence makes me wonder whether your proposed case is as airtight as you may think. Without disputing the New York trust law, which by the way may not be all that different from California's, my immediate reaction to "never properly transferred" is that it may be a big "so what?"

Nevertheless, if you would be kind enough to send me, off the bulletin board, a factual background of the proposed case (two to ten pages, preferably), I'll do a free critique and maybe a referral.

I agree with Mr. Whipple that from the limited information you provide it doesn't sound like your case is a "slam dunk" by any means. Although the information is so limited there is no reason to believe it is a bad case either. The red flag for Mr. Whipple and me is that the vagueness of your question suggests you are not fully aware of or do not fully understand the relevant legal principals involved. A deed of trust is not a normal trust and normal trust rules do not apply. It is also unclear what New York trust law has to do with the situation, since a California deed of trust would be governed by California law. So it is difficult to really even begin to evaluate what you are talking about. However, my main office is in Walnut Creek, and I have nearly 25 years of real estate law experience, including over six years as a vice president and senior litigator for the parent of Fidelity Natl. Title and Chicago Title (among others), and including their trustee sale subsidiaries. So I know my deed of trust and foreclosure law. Technically it does not require your husband's signature. The danger to you is that if your husband claims a community property interest has been created in the property in the time after you bought it, which is not uncommon if any payments were made for it out of earnings during the marriage, then you could be at risk for breach of the sale contract by failing to convey clear title, and the buyer could be at risk of not receiving clear title. For that reason, it is common practice for the seller who holds record title as married person, sole and separate property, to sign a grant deed, and the spouse to be required to sign a quitclaim deed. The alternative IF the buyer will accept it, is for both spouses to sign a single quitclaim deed.

For the reasons he states, technically it does require your husband to do something, e.g., sign a quitclaim deed, either jointly with you or a separate quitclaim deed....IF a community-property interest, however tiny, has arisen due to use of community earnings (your paycheck is community earnings) to reduce the principal amount of a loan balance on the property.

The statute of limitations for property damage is probably 5 years; for personal injury, probably 2 years. But it is the filing date of the lawsuit that matters, so if it was filed within 2 years and service was delayed, it's fine. Note that you MUST assert the statute of limitations as a defense or it is waived. If you don't respond properly to the lawsuit, judgment will be entered against you. Also, you don't say how the matter happened (and you should not post facts here), but it may well be covered by your car, homeowners, or renters insurance. If so, contact your insurance company immediately.

If so, she is in contempt of the automatic restraining orders that are printed on the summons and go into effect as soon as you file as to you and as soon as she is served as to her. If so you can get a contempt citation issued against her which will expedite things in TX. You should also file a child abduction police report. If you have not yet served her, then Ms. Kock is correct, you need to file a motion for an order that the children be returned to California. If you serve that order on her in TX and she refuses, then you will have to have the order enforced by TX authorities under TX law governing enforcement of out of state orders (a fairly common and routine process but not necessarily a simple one; you'll need a lawyer in TX).

I live in Georgia, and was recently pulled over by municipal police for allegedly "throwing things out of my window" at the vehicle behind me, way outside city limits. This person was tailgating me for miles, and I only threw a cigarette out of my window, which happened to bounce off the front of the SUV on my tail because they were following so closely. This person had called the County Sheriff, who directed the call to the city police, who waited for me to come inside city limits so they could pull me over. They pulled me over immediately, with no other basis, and the complainant never even gave their name or information. Is this a legal traffic stop? I received a ticket for Failure to Maintain Lane, for jumping out of my skin when I was turning a corner, after the cop already had his lights on, and decided to turn on his siren as I rounded the corner. As a reflex I jumped, and looked straight to my review mirror, but was told when I did that, that I swerved outward and crossed out of my lane. I think this is ridiculous and Im trying to research whether this was a valid traffic stop to begin with.

Of course it is. You littered, which is grounds for a traffic stop. Besides the harm on the enviornment that smokers cause by throwing butts out the window, that can cause a fire. That gave probable cause for the stop, since you clearly broke the law and there were witnesses. An anonymous call can justify a momentary traffic stop.

And swerving when you hear a siren is also inappropriate. Nothing in the post, other than your acts, are "ridiculous."

The water was flowing through the hardwood floors into the finished basement below. The walls, ceilings, and raised flooring in most of the basement are destroyed and so is the hardwood floor in the room where the leak occured. We called the sellers real estate agent, and she said don't worry about it, they would have it all fixed asap. They had a crew in, and fixed the leak, then had a contractor in to quote the damage repairs... Now they are backpedaling... Trying to cover their own hides since they were supposed to winterize and didnt. It turns out that the reason for the pipes freezing was that they left the heat on and the oil tank ran dry. Of course, since my real estate agent was assured everything would be fixed asap, we went ahead with the closing, and then two days later the back-pedaling began, I believe because they realized that the damge was much more severe thatn they had previously imagined... What rights do I have? I can not afford to fix the damage myself, and my insurance will not cover damage that occured before closing. I have since had to pay a restoration crew to come in and clean up, and dry everything, to try to avoid further damage ($1,000.00 so far out of pocket). This is also something they originally were going to do, then came back and said I had to do it, or risk further damage to the house. The house is in Massachusetts.

If the will was not probated, there is no way to find out if there is an addendum, codicil etc. In Utah, you can deposit a will with the court prior to probate, for storage purposes, but there is no requirement to do so, and most attorneys don't do this because of the inconvenience if a client moves, later makes changes their will, etc. A will does not become a public record until and unless it is probated. If there are missing documents there is little you can do, unless you can get a copy. To have the 30-day waiting period waived, you need to request it from the Court in your Petition (you can file an amended petition for free typically and does not affect the time requirements). And then again in your decree. Since you didn't mention it in your post, make sure your spouse signed the waiver of service and it is also filed with the Court.

Item 5. in the document DEPOSIT reads " The Parties agree that the Deposit shall be disbursed by the Escrow Agent to the SELLER.

My agent sent me $500.00 and told me North Carolina law states that the forfeited ernest money be spit 50/50 with the listing agency and the seller.

Never heard of that personally. Ask the Realtor to show you the "law" or better call the North Carolina Real Estate Commission and ask them (ncrec.gov). If they say there is no such law - then find a new listing agent (but make sure you have them sign a termination).

It does seem to me that the vast majority of the contact and the secret visits were to see the girlfriend and the mom was just encouraging (and participating in) the lying and facilitating the sneaking by picking him up. The one exception that I know of for that is when she ate lunch alone with him two days ago. So, while I don't disagree that maybe police involvement is a possible path, I was hoping to make sure first by reading the rest of the texts.

Well technically, no they cannot search your trunk because you were speeding. However that simple question implies too many facts and questions: what was the basis for the search (e.g. inventory search? heard screams?), was your trunk searched because of speeding or because of some other reason? Did you give consent? (and many many many many many people do). Furthermore, often people ask questions that imply an existing legal dispute and attorneys generally will not want to get involved unless they can give a decent answer, because we've all had clients come in and get angry because "some attorney on the internet" said something contrary to what we're telling the client because the "guy on the internet" knows absolutely nothing about the facts, the law, the application to case, the jurisdictional precedent, etc. etc.

Finally, there is an ABUNDANCE of criminal law questions that get posed. It is ABSOLUTELY STUPID to an attorney to answer such a question online, and just as stupid for someone to try to save money by doing it themselves (or by not accepting assigned counsel). You think you're smarter than a prosecutor about the law and legal procedure? Great way to get on the fast track to jail.

Besides, many attorneys will offer a free consultation for many areas of law to give a basic case evaluation. Take them up on that. But if you think explaining something in detail isn't worth your time, then why would an attorney waste their time on you?

I was pulled over and given a violation for using my cell phone while driving in NYC. The phone was in my lap when I was pulled over. I wasn't using it hands free or otherwise. I was scratching my ear. My phone bill shows there were no calls going in or out of my phone for 20 minutes before and after when I was pulled over. I'm going to fight this in court. Other than bringing in my phone bill, do you have any suggestions for me?

A witness in the car would be helpful. You might want a certified copy of your phone bill and bring the bills of any other person in your family with a cell phone since the police could say you had someone else's phone. If there is more than one phone in your name or your phone bill is in some other persons or employer's name you might want someone with authority to testify that this is the phone you use and do not have authority to use any other phone.

I recently filed for H4 Change of Status and yet to get my receipt notice.

my employer came back to me with an offer to take up an opportunity with my location preference that i asked for earlier.

Yes, you can file for an H-1B EOS as long as you qualify.

You can submit a request to withdraw the I-539 with the Service Center that is processing your case. However, you need to make sure that you do not have any periods of unlawful presence or your EOS might not be approved.

I highly recommend that you have an experienced Immigration Attorney review your case to ensure that you don't do something that will inadvertently harm your status.

Three years ago my mother placed her house in my sister's name and mine. She wanted to do this in the event she became ill and allowing her to use medicaid. However, she can no longer claim homestead exemption thus we are paying higher taxes with the home in our name. At this point, should we add her name at the bottom of the deed as Life Estate or leave it as is? I understand there is a five year waiting period to be eligible for Medicaid. As it stands she will have to wait two years more to be eligible or if we add it to Life Estate she will have to wait five more years to become elibible for medicaid if necessary.

Well, it must be coming from you if it's everywhere you go, you could also be either imagining it, or there is something wrong with your sense of smell, or the part of your brain to processes scents. If you wear the same scents (shampoo, cologne, perfume, etc) everyday the combination of scents could be released when you stand a certain way, or one of the scents degrades over time so that the overtones disappear, and you are left with the long lasting undertones which you don't recognize as what you put on in the morning, or what's left on your clothes, so it seems new and different to you. You could have something actually stuck in your nose or sinus. If you have certain diseases like diabetes you could be smelling your own skin/breath, if it's sweet and fruity. Of course, anything is possible, and it very well could be your mother :)

I have had to fill out some forms and jump through a few hoops to try to get into this school with this mark on my record, understandably. I also got into a scuffle with my college boyfriend two years after the retail theft charge. Throughout this scuffle, I damaged his bedroom door. He went to the police for it. I turned myself in and was told to pay for the door and there would be no mark on my record for this. And there is not. However, today I called the district court where this occurred because the school I applied to needed me to contact them to obtain my files and information pertaining to my retail theft summary offense. The woman told me that the "door incident" was showing up as a summary offense as well. Like I said, the only thing that has showed up on my background check is the retail theft summary offense, nothing else. My question is... What do I do about the other summary offense with the door that is showing up in the files at the district court? On my application I wrote that I was convicted of a crime once... which I thought was true... the retail theft which is the only mark on my record. The school is going to obtain information from the district office and will see the other summary offense. What should I do?

The district court may just be showing something you were charged with and not something you were convicted of. THis may not appear on your PA state police criminal record check. If the retail theft is five years old or older, you may qualify to have this expunged from your record.
