I have a family member who is currently incarcerated since 1999 on a charge of robbery and unlawful wounding. He pled guilty, and was sentenced to I believe 19 years all together. He has been in prison for 12 years, and with good behavior, is scheduled for release in Feb, 2014. He is a security level 1 and hasnt gotten an in-house charge in over 3 years. My question is, since he has served so much time already, could he go before a judge and ask for a sentence restructure/reduction? Is there such a thing in Virginia? And because he pled guilty, would he even be eligible?

No, at this point in his sentence, I see virtually no chance for

such a reduction in his current sentence, but, of course, if the

inmate wanted to try, what would he have to lose?
