You failed to tell us if you did or did not reassume the mortgage. Whether you did or did niot file one creates two completely opposite answers. Tell us which one you did.

It depends. Bankruptcy aside, if the mortgage company forecloses and gets a deficiency judgment against you, then yes, they can garnish your pay.

However, you filed bankruptcy previously. What happened there? Did you get a discharge? Or was it dimssised? What kind of bankruptcy did you file, a chapter 7 or a chapter 13? Was the house and mortgage included in the bankruptcy? Did you reaffirm the debt?

If you do not know the answers to these questions, you need to review your bankruptcy paperwork and possibly speak with your bankruptcy attorney. If this was a new mortgage that you incurred after the bankruptcy, you do not indicate how much is owed and whether a deficiency judgment is possible. You also do not explain your circumstances in much detail, although from what you have stated, I assume that you are working somewhere as a W-2 employee and that you are not self employed.

Depending on the answers, you may need to re-file bankruptcy, either to try and save your house or to avoid a deficiency judgment.

Adopting a child who does not have legal status is complicated and your aunt will need to hire an attorney who (a) practices family law and adoptions; and (b) is familiar with how to handle the special legal considerations raised by your immigration status.

Interestingly, if your parents have abandoned you here, you have a good chance of normalizing your immigration status and becoming a legal permanent resident (green card) and then a US citizen, with or without adoption.

If your sister is able to assume the mortgage, which would need to be determined by the lender, she can assume the mortgage or she can purchase the home outright from the estate as well. Either way, you would need to probate your mother's will in order to deal with the issue of the property. Unless it is retaliation for protected conduct, such as filing a wage and hour claim, union organizing, "whistle-blowing" or other specifically protected conduct, you don't have a case. I am perfectly ok with accepting an underage alcohol charge though it seems odd that an officer is allowed to search through personal belongings without consent or probable cause. It may have a provision that this arrangement is to stop once she starts school, or it may just have the week on, week off language, with nothing else specified. Your daughter will have to look at the order to determine that. The fact that this is bothering you so much means that your business needs a no check policy. When a business owner can't sleep at night, he needs to make his decisions accordingly. Especially since bad check notices are mailed, and the postal service is slow these days, five days is NOT long enough to wait. The oldest child graduates this June and support ends for him. Decree specifies I continue to pay support at a sole custody rate for the youngest.

As far as holidays and regular parent-time. Nothing has changed with our parent-plan. I've always had the schedule I have and I've always paid extra. The agreement was extorted out of me during mediation, that is, as a father you have to pay extra to get the mother to agree to joint custody.

Is there anything that can be done, to decrease the amount of support I pay so the amount aligns with the child support calculation? I'd like to be able to help my oldest with tuition rather than pay his mother extra.

Both parents are professionals, working full-time, earning near equal, six figure incomes which have not varied much since the divorce.

You may take the matter before the court again, and seek an adjustment based on the number of overnights and the respective incomes of the parents. We moved inour house in August of 06 and signed a one year lease to August 07. We have been living in house since then and have never signed another lease and as far as we understood we were on a month to month basis. We wrote our landlord and told him of our plans to move on January 15th. He called back and said that we have to stay in the house to August because we promised to be there for 5 years. We never promised to be there for 5 years him and his wife had a five year plan to move into the house we are living in after 5 years. First off the 5 years were up last August of 2011 any way and he said if we try to move he will contact his lawyers. I have been reading up about landlord tenant laws and there is a section in there that speaks about using your security deposit for your rent. Our landlord has never given us any information about where our deposit money is located, we have never seen a statement and interest has never been discussed with us. He has $1950 of security one month rent plus an additional half month for our dog. I would like to put it in writing to him that he can use the security for out last month and half rent and that we won't be giving him any more money. This will also avoid having to deal with the hassle of getting our deposit back because we already know he will make that a problem. The house is in great shape and has no damage. ( We will taking Video of the house before we move out) Is it possible to have him use that money for the rent since it doesn't seem that he followed the rules of the security deposit?

Your question poses several issues for which you should retain an attorney to protect your rights. Although you may not have signed a new lease the terms of that lease remain in effect. (1) If you did not sign a new lease, you are on a month to month tenancy and can leave by giving one month's advance notice. If the landlord had presented you with a new lease, the situation would be different but he did not. (2) If your landlord has not told you where the security deposit is kept, you may apply it to pay the rent and can never be required to restore it. (3) Taking pictures is a very good idea. You may also want to get a witness to look over the premises before you leave because you anticipate a problem. Do both sides a favor: Be sure you turn over the keys to the landlord and get a receipt. That will establish that you have vacated and the landlord will then not be required to sue to have you evicted.

Before or after filing for bankruptcy does not matter. Any mortgage is a secured debt (it is secured by the house). It gets listed on Schedule D. Likewise, a car loan is a secured debt (it is secured by the vehicle). A car lease or residential rental lease, by contrast, is a contract and gets listed on Schedule G.

It's not likely, but it's possible under certain circumstances. Courts are reluctant to pierce the corporate veil, but if certain facts can be shown that would prevent an injustice, it can happen. However, this is pretty rare. More facts need to be known about your situation to determine if you have exposure. Of course, if you aren't personally named as a defendant, then you are not a party to the suit and you can't be made to personally pay the debts of the company. I would recommend consulting with a knowledgable business attorney (whoever was used to incorporate would be a likely candidate) if only to give yourself some peace of mind.

There is a standard period following a criminal conviction in which to appeal. That period is measured in days not years. Your husband could make an appeal based on ineffective assistance of counsel, but there is always the danger that the sentence returned in the new trial could be even greater than the one from the initial trial. His DUI might still be appealable, if too much time has not passed.
