My question comes from reading the obscenity statutes and the note that ignorance of age is never a defense, but still the term "knowingly" is used to describe the person who commits the offense of using a minor to make such materials. I'm confused, because it seems rather outlandish if true as knowingly is defined as knowing the age in the previous section. Can someone please explain what knowingly means here?

Ignorance of age is not a defense to sexual battery or lewd and lascivious charges. Not sure what you mean by "sexual story." Sexting with a minor would be illegal though if you know the person to be underage.

FINALLY someone asks the right question in this situation. Everyone else wants to know when the child can CHOOSE where to live, and the answer to that is never, until they are no longer a child. BUT the opinion of the child is ALWAYS relevant once the child is mature enough to form an opinion that is genuinely their own. How much weight it is given is based on the court's evealuation of the maturity and intelligence of the child, and whether the child is being influenced by the parents or forming an independent opinion. How strongly other factors weigh will also have an impact on the weight given the child's opinion. So if one parent is a drug addict and homeless, the child's opinion that they want to live with that parent will not get much weight. If each parent offers a good household, however, and the child is a mature 16 year old with a good head on her shoulders and a well thought through opinion, it will be given strong weight.

If you don't know where your spouse is you can still get a divorce you will simply need to serve him by what is know as a legal publication. You should not try and do this yourself - you will just muck it up. The lame 'o excuse of I can't afford an attorney is simply untrue. Our firm does this type of divorce for a fee of $100. My husband (of a week) has a custody order that has been broken by both him and the custodial parent. The mother made a stink about a year ago because she found out he and I were dating. She made it VERY difficult for my husband to see his daughter. I.e., "she is sick" "she has soccer practice" "she has a play date" "she doesnt want to see you". After a few weeks, he wrote her an e mail and said he was going to give her the mother some time calm down and let the daughter stay with the mother on his days. After while, he tried to re-establish his normal visitations. There have been NUMEROUS e mails and phone calls requesting assitance from the mother, and NUMBEROUS e mails with her response dancing around a practical "No you can't see her". She's not dumb, she keeps saying that she will not force the daughter to go anywhere and that since this was his initial decision that he has to work it out with the daughter (She will be turning 12 by the way). Is this legal? They have a court order estagblishing visitations. She keeps saying if he takes her back to court that she will ask for more money, but that if he leaves things the way they are than everything will stay the same. All her e mails are ridiculously long and most of what they say is that the daughter does not want to see him. Apart from being hurtful, how do we even know that is true? What if she is telling the little girl, that my husband doesnt want to see her? This year has been hell for him. Anyone, please help. Can she really do this? And will thousands have to be dished out again because she doesnt want to follow the custody order??

The ex is obviously not going to do anything different than what she is doing, because it is working fine for her. Your husband has made a grave mistake letting it go this long. Earlier it might have made sense to take a copy of the order and go over to the ex's house and enforce it, with a police officer on "civil standby" if necessary. Doing that now, however, will put your husband in a bad light for waiting so long and then fomenting a crisis. His only option is to leave things as they are, or go back to the court for a new order and then enforce it. To put the ex back on her heels a bit, your husband may want to start the court process with an Order to Show Cause why the ex should not be found guilty of contempt of court for violating the existing order. Anyway you approach it, however, at this point he is going to need an attorney.

It sounds like mom isn't going to cooperate and you will need to go to court to enforce the visitation schedule. It is not up to the daughter whether she wants to go or not. The parties need to abide by the order. You can file a motion to enforce the order. If mom's behavior has been really egregious you could ask for sanctions as well.

The sad fact is that your husband and his daughter are being denied the parent and child relationship that they both deserve. Your description also suggests the mother may be turning the child against her father. If this is the case, this behavior by the mother is called parental alienation.

When your husband's daughter turns 18 (or up to the age of 19 if she still is still in highschool) she will be considered and adult and can choose how she spends her time with her parents. Until then, her right to have contact with her father can and ,in this case ,should be directed by the family courts.

Your husband should file a motion with the court to enforce the visitation and also request make up time to recapture the visits that were missed.

I hate to chime in when so many others have already answered, but I did want to mention this: she can come in at any time and ask for more support based on him not exercising his visitation. It doesn't matter that she agreed not to. Just to see how much she can nail him for, you can get an idea from this calculator provided by the State:

The mother and child cut me off and was alienated when I was able to get her into (outpatient) rehab the first time (she had two more after - starting at age 16) CPS nor the courts would intervene. Finally my daughter was arrested for drug possession and dealing (at age 17) and allowed an Adolescent Diversion Program where the charges would be dropped if she was in a residential rehab program for 9-12 months. (otherwise class C felony and one year jail time).

Since our daughter no longer resides with mom, what are the NY legal statues that would suspend or terminate my child support. Also based on the criminal activity and/or the child not residing at mom's house (actually moved in with her boyfriend over the summer and was living there until arrested in last week of October (and was not going to school either) - has she technically emancipated herself. She is attending classes at the rehab center

You may not simply stop paying child support. You need to move in court to modify the order or declare emancipation.

If you just want out without liability it may not be to your best interest to void the LLC. There is not much information provided in this question but I will try to answer it. If the person had a will and probate has been started the property will be transferred during the probate process. Once a Deed of Distribution has been done the interest in the real property transfers. The new owner can sell the property after it has transferred. If you are in probate and want to sell the real property during probate I would ask the probate court if you are able to sell property. The will may give you the power to sell and if not you may need to ask the court for an order to sell. If probate has not been started I would suggest starting probate so the property can be transferred to the beneficiary.

What Form do I file to get the "Court" (since the Court has Jurisdiction) to nullify previous "Agreement(s)" (because of a pattern of constantly abusing the agreement---picking and choosing what part of the Agreement to abide by and ignoring the rest) and taking over with a Court Order. Originally, prior to Agreement, I requested the Court to decide and Order how Spousal Support Arrears would be paid. If I would have know how there is no "Contempt of Court" consequences with an Agreement, I would have gone ahead at let the Court Rule. Now, what are my options?

Your history is a bit confusing. Generally an agreement is made a court order and that can be enforced by contempt. I recently taught a seminar to attorneys in the El Cajon Courthouse on collection of child support and spousal support. I opened the seminar by stating that Contempt is rarely a viable solution. I would suggest that you talk to a family law attorney familiar with collection and enforcement of support and other orders. Take in all of your paperwork.

Performing in good faith applies to her school work and behavior towards school. At the age of 19 you can discontinue the support unless your ex spouse takes you back to court to show that she will graduate at a later date and you may have to continue until that date. But it must be reasonable and within the school critera. The fact that she has been absent only shows she was out ill.

You should be happy that she is at least trying. Have you thought about getting her a tutor and supporting her through her academics. Have you been to her school to see what has been going on, talking to her guidance couselor, her teachers?

You can't force a settlement on them. You can only explain your circumstances. If you are not currently working and have no cash there is not much they can do about it now. However if they are determined they'll wait for you to find work and then they'll garnish your new salary at 10% of your gross pay until the full amount of the judgment (they have to enter judgment to garnish your salary)...but right now there is not much they can do...

You can't depose a non-party witness with just a deposition notice. That requires a deposition notice and a subpoena. If you are not an attorney, you have to have the court issue the subpoena. If you want the documents in advance, then that will be two different subpoenas, one to get the documents early, and then a second one to take the deposition.

There are all kinds of procedural rules, and the space here is to short to list them all. You really should have an attorney assist you.

I waited and waited for a doctor to see me until it was too late. surely my lungs were closing and I could barely breathe. it wasn't until I could no longer talk that a doctor came over to look at my lungs and discovered that my lungs were infected and closing by the minute. the doctors then decided that they had to immediately place a tube down my throat so that I can breed. I did not have insurance so the doctors were discussing if they were going to put a tube down my throat in the emergency room or in the OR room in front of me as it was a debate as my situation got worse . after about 5 minutes of debating the doctors then decided that it was best that I be moved to the OR room. Once in the Or room I then thought it was over for me. The doctor then tried the push a tube down my thought while awake, of course that was very difficult because by that the my throat was the side of a pin needle say doctors. Each time they tried to put the tube down my throat I would gag. I then went into panic mode because I felt like I was going to die. I guess at that point the doctors realize that pushing a tube down my throat was not going to work while I was awake in little time they had to save me. That's when they put me to sleep and I woke up three days later. The nurse was very unexperienced and never checked my throat and assume that I had a sore throat. Can I sue this hospital?

First of all, your Dad should have general liability insurance, and perhaps, special coverage for potential medical claims. And the first thing he should do in the event of an incident is to automatically tender the claim to the insurance carrier.

Second, the insurance company may require you to have a lawyer-prepared rental agreement as a condition of coverage because good contracts can drastically reduce legal claims and costs.

Third, whether the insurance company requires this or not, it is a very good idea to have a good contract. While it is more difficult to disclaim liability for bodily injury than economic damages, the agreement can be drafted to make clear that it is only a product that is being provided not advice, particularly not medical advice, regarding the choice of that product. And damages can be limited and some claims prevented or made much more difficult by contract. And, drafting or reviewing and revising contracts is not expensive - MUCH. MUCH less than just the initial fee of a lawsuit.

(By the way, having insurance "gives you the right to sue your insurance company." By the time it shows up your Dad could have a default judgment against him, so your Dad will need to have his own legal counsel initially. Naturally, having the firm which wrote the contract on board relieves stress and saves time and money.)

So, overall the business risk can be reduced by having your contracts in order, as well as what I call your "legal brick house." You can file suit. To accuse someone of a criminal act is what is known in the law as "Defamation Per Se". It means that it is presumed to be a statement that causes injury to one's reputation and malicious intent is presumed if the statement is untrue. You can file suit in a small claims court without a lawyer.

All that being said, I would do some research first if I were you. See if the place has a history of falsely accusing people, or if the owner has had complaints of racism. Also, go talk to the owner and ask to see the camera footage to see if they had any justified belief that it appeared you were stealing. It could be that it was an honest mistake and the camera angle made it APPEAR that you took something. If they refuse to show it to you or become overly defensive over the questions, that may be some evidence that your suspicions about their being racist and unjustified in their accusations are correct.

My immediate concern is your use of the term common law relationship. California law does not provide for common law marriage, and cohabitation alone does not create any community property rights.

You are asking questions concerning probate which reveal that you don't fully understand what the probate process is all about (this is not a criticism, but an observation). Probate is a legal court proceeding created to provide a mechanism to transfer property owned by a deceased person in their own name or property or income payable to their estate to be retitled in the name of the surviving heirs or beneficiaries legally entitled to the property. If mom deeded the property to her two sons, then the property belongs to the two sons starting with the day the deed was signed. A deed is a mechanism for transferring interest in real estate from one party to another. The property doesn't belong to mom anymore, so there probably is no need for a probate proceeding. If the quit claim deed was correctly prepared, the deed from mom to the two sons gives the son their interest in the property. They can do with the property what they wish, subject to the claims of any creditors who have a lien interest in the property (mortgagee banks, construction liens, Department of Public Aid, IRS or Illinois tax liens, if any, etc.). And when the sons die, if the property is not sold before that date, the property will pass to their heirs, beneficiaries or surviving joint tenants. The sons would be well advised to get an appointment to talk to a lawyer in their county who specializes in real estate to obtain an opinion as to what their rights and obligations are with respect to the property. The fee they will pay for a consultation will be worth the fortune they will pay in legal fees if they move forward without knowing whether the deed mom signed was legally sufficient to transfer title to the property.

Whether you can get out of the deal depends upon the language of the home inspection clause. If the floor issue is so important to the deal that you want to get out, you should obtain a lawyer, get an opinion as to whether or not the language of that clause would allow the negation of the deal and then move in that direction. Or maybe you can negotiate a lower sales price. As to pressing charges, I doubt that this statement in the MLS would arise to criminal intent.

What ever procedures you might have violated, none of them lead to your children's injuries or probably made them worse. You definitely have a case, but it is likely not worth very much. You could hire an attorney to spend 1-2 hours to write a demand letter in the hope that they will settle with you and then sue in small claims court if they do not. I do such things at $100 per hour.

You do not detail a lot of the relevant facts here. How much assets are in the estate? What is the value of the car? Does the estate need to sell the car to raise cash? What does the will, if any say as to who gets what?

The answers might dictate what happens. If there is no will and no debts and you and your brother just spit the estate (land and all other stuff) equally, then maybe he gets the whole car if he wants it and it counts towards a piece of his share. You get some other combination of assets equal to the value of the assets your brother got.

If the estate needs to raise cash, how much? It may be that since your brother has already inherited half the car he only needs to pay for 1/2 the value of the car into the estate. The estate bills are then paid. Your brother's half of the car is still assigned to him as part of his share plus whatever is needed to equal 50% of the net assets and you get the other 50%.

Since there is an estate lawyer, I have to assume that if the lawyer is reasonably competent that this will be handled correctly and each beneficiary will receive 50% of the net probate assets. If you feel you are being shortchanged, if you are not the executor and the executor and/or estate legal counsel does not adequately explain this to you, then you need to go and hire your own independent probate counsel to review the details and relevant documentation (will, if any, inventory and accounting) and make sure that things are done correctly.

How difficult will it be to get back in to court to have his sentenced reduced or restructured? Since being incarcerated he has gone through voluntary rehab for alcohol and drug addiction (he earned certificates), he earned certificates for fabrication and welding after completing 1900 hours in each job area. He has been a part of three tutoring programs, in which he tutored men and in preparation to take their GED. He is currently tutoring for the GED, with four men having passed their GED test in past year. He has worked some type of job at every facility he has been assigned to, even though he was told he could not get time off for good behavior or for working. I want to know how hard it would be to hire an attorney to get him back in to court to have his sentence restructured or reduced? He has served 16 years so far.

You can do it without "agencies" however, I wouldn't recommend trying to do it with out a lawyer as there are lots of ways to screw the process up.

I am sorry to inform you that you have no rights to contact these children. While Massachusetts does have a law for grandparent visitation, you would not qualify under this law because the law has been restricted to cases where the grandparents have such significant prior contact with the children that they have been acting as the parents or the equivalent. It appears that you do not.

Under Massachusetts law, grandparents have the right to petition the court for visitation with their grandchildren. The court looks at several factors to determine whether to order visitation for the grandparent, including their past relationship with the child. The court will also consider the reasons presented by the parent for not wanting their children to visit with the grandparents. If the court orders visitation, then the parent must comply. If the parent does not comply, he is in contempt of court. Therefore, the court can order your son-in-law to allow you to talk to your grandchildren. You would need to locate your son-in-law before you could file an action in court but it is usually not that difficult to locate someone.
