My folks set up an irrevocable trust years ago, with my brother and I as beneficiaries. My Dad passed away recently, and now my Mom seems helpless regarding this trust. She has been told that she isn't even supposed to write a check to buy groceries with the money in the trust. All money should be used towards maintaining the property. She needs to sell a piece of the property in order to make repairs to her home, but she isn't supposed to do that either.

She can not afford attorneys, or a court case to get rid of this trust. She is barely surviving on what is left of my Dad's retirement. She is a senior, on a fixed (small) income. Is there any help to get rid of this trust without all the court fees? Is there a senior advocate that can help her?

My brother and I would happily disown any rights to this darn thing. It seems impossible that she can't even make decisions about her own property, now that my Dad is gone. If selling a piece of the property is necessary, in order to maintain the home, "property", why isn't this allowed? Also, there is so little money in the trust, that court fees would surely eat it all up.

Unfortunately, under California law the only way to modify or terminate an irrevocable trust when the settlor is deceased is to petition the court unless the principal value of the trust is less than $20,000.

I suggest that your mother meet with an attorney, she should meet with one who will give her a free consultation and who specializes in trust administration. That attorney can review the trust and all the circumstances and advise your mother. Without seeing the terms of the trust and knowing all the particulars, it is difficult to give a complete response.

I disagree with Ms. Rouse and agree with Mr. Selik. I suggest seeing an attorney and having them review the trust. Trusts don't require court proceedings unless there is a dispute between the trustee and the beneficiaries, which it sounds like you don't disagree.

Probably not, especially in rent controlled L.A., unless the damage is really substantial and cannot reasonably be repaired at the tenant's expense.

The cabinet is rotten because the plumbing leaked, but you don't tell us what caused the plumbing to leak. If it was misuse, or intentionally damaged by the tenant, then I would say you have grounds to terminate the lease. But if it is wear and tear, the landlord is responsible for the repair, and cannot use this as grounds to terminate the lease.

You did not steal the truck. But that does not mean criminal charges will not be brought against you. It really depends on how many contacts the finance company has with the political leadership in your city. The dealer has 10 days from the date of sale to notify you that you did not qualify for financing. If you turn the truck over now, the finance company will sue you for a deficiency. He was originally sentenced a 7 year and a 10 year sentence of which he served 2 and got out on dual status. He went to CO without permission. If convicted of the CO crime will his sentencing run together or will he have to serve sentence in CO then be extradited and serve sentence for violations? What is the likely hood of MO extraditing him on the violations? If the person making the stolen car report lived in MO why wouldn't it be a MO charge? Would the person had to of called CO or went there to make report? Is there a set amount of time he will have to serve for the violations or is it up to the judge?

CO and MO have concurrent jurisdiction for the car theft if he was caught in CO with the car, but it was stolen from MO. Both could prosecute him, but that is unlikely and there are statutes that can prevent that. If the car was stolen in CO and he was caught in CO, but the owner lives in MO, then it will likely stay in CO bc all the evidence and witnesses are here.

It is possible for the sentences to run concurrent, but only if there is an agreement with the prosecutors offices. Judges can run a sentence concurrent to an already imposed sentence. So, if there are two sentencings (one in CO and one in MO), only the 2nd judge can impose a concurrent sentence without an agreement with the prosecutors.

It appears the MO cases are felonies. Most of the time, states will extradite for felonies. I would expect MO to extradite him, possibly after his CO sentence. He should file for speedy detainer, but that only protects him where there is not yet a conviction. It sounds like the MO case is post-conviction.

Sentencing is almost always up to the judge.

I am very sorry to hear about your baby and I hope he recovers fully, but every baby car seat manufacturer tells users NEVER to put their car seats on top of a shopping cart. Read your instruction manual. It says it right in there. When you add to that the fact that you didn't even have him buckled, AND you knew it did not fit well, if you sue Ross they will win without even trying hard. You are responsible under the law, not Ross, for proper use of your baby car seat.

There is nothing generally wrong with another collector (or lawyer) attempting to collect. As far as "harassment," many people consider it harassment when they have failed to pay their debts so long that a creditor has to hire a lawyer or collector. There is an easy way to stop it, or to keep it from happening in the first place.

As far as calling others, that may or may not be OK depending on what the collector said.

First, while I am very sympathetic to debtors, you are not being "harassed." The creditor has a legal right to collect the debt, provided that the statute of limitations has not expired or there are not other grounds barring collection of the debt. So yes, it possibly is legal for another law firm to contact you, depending on the facts.

That said, the debt collector (or law firm masquerading as one) does not have a right to speak with your neighbors or employer about this debt and this is a violation of federal debt collection law.

I am curious, was the first lawsuit dismissed "with prejudice" or "without prejudice"? It is important. Dismissal of a lawsuit "with prejudice" means that there is no way that anyone can sue you in regard to the prior debt. If the suit was dismissed "without prejudice" it means that a new legal action can be instituted. If you are in Georgia, this can only be done by a Georgia-licensed attorney.

You are not going to get paid through escrow unless you have a lien in place, either consensual, or a nonconsensual lien through an abstract of judgment. If it has been 21 months, you are looking at the statute of limitations running out on a verbal agreement, which is two (2) years. If you cannot get anything from him voluntarily, you need to file a lawsuit.

The civil case never was able to garnish his wages because they lost their house due to sheriff's sale and moved 2 counties away and then out of state. (If they had moved to an adjacent county then the Court could have garnished their wages). In Ohio, once a debt is discharged in bankruptcy, you cannot take any further steps to collect upon that debt without running afoul of the bankruptcy court's discharge order. However, you should check how the bankruptcy proceedings unfolded. It sounds like the guy who took the money was guilty of fraud. If you got a default judgment against the guy, and of the of claims for relief was for fraud, then fraud is not dischargeable in bankruptcy.

However, when the bankruptcy was filed, you should have received notice that you needed to file a "proof of claim" in which you could argue that the debt to you should not be dischargeable because it was in the nature of fraud. If no one argued this and the debt was discharged, you may be out of luck.

Why did you not take probation? You and your PD were negotiating a plea deal that drops charges in exchange for probation on others. If you tanked the plea deal they will try you on all charges.

Do you really want to take to trial? What if the unauthorized search turns out to be legal and they can admit the evidence. You then have all the charges and the jury could find you guilty.

Your PD probably had a good deal going...don't be so arrogant that you think you will beat the charges. Your time to challenge the search was when the cops wanted to search...

It appears as though you are really asking the definition of community property. In California Community Property is all property (assets and debts) acquired during marriage except for property obtained by bequest, devise or by gift. Basically this means that all assets and debts acquired during marriage that were not the result of an inheritance or trust or given to someone by a family member under specific circumstances are subject to court's jurisdiction and may be considered community property. However, there are lots of exceptions and there are lots of ways to change the character of property from community property to separate property and visa-versa.

So without knowing the circumstances it is impossible to give you an accurate answer. However, if your husband worked during the marriage and a portion of his pension was earned during your marriage then it may be considered community property. Although, the portion of it that will be considered a community asset is relative to the time of your marriage and the time of your separation. As you have describe it both pensions may be considered community property and you may have a right to a portion of both pensions. The IRA or annuity may also be community property if it was put into place during the marriage. If the source of the funds in the IRA were earned during marriage then even if it was started prior to the marriage at least a portion of it may be considered a community asset.

Unless you are an attorney, YOU can do nothing for him but hire him an attorney and tell him to to exercise the 5th Amendment right to SHUT UP and do NOT talk to ANYONE about the case except his attorney. It is already too late for him to refuse consent for the search, and the evidence they found will not likely be "thrown out". He may have already 'blabbed' to the police about the facts.

Of course he can still fight it. Raise all possible defenses with whatever admissible and credible witnesses, evidence, facts and sympathies are available for legal arguments, for evidence suppression or other motions, or at trial. He faces potential prison / jail and fines, so handle it right. Not exactly a do it yourself project in court for someone who does not know how to effectively represent himself against a professional prosecutor intending to convict and jail you. If you don't know how to do these things effectively, then hire an attorney that does, who will try to get a diversion, reduction or other decent outcome through plea bargain, or take it to trial if appropriate. Hi, I live in Los angeles and have had an ongoing neighbor dispute. I have 2 separate police reports one for a battery and one for vandalism. I have security video evidence of her physically pushing me and also of her trying to destroy my security cameras to which she was successful in my having to replace 3 of them. She has deliberately banged on and what I can only describe as drilling on our adjoining wall in the same spot for weeks on end which I have recorded (audio only) with whatever device I have had handy at the time it occurs.

We live in a quadplex and the front yard is community property and one day when my daughter and niece were playing in the front yard my neighbor came home and got fertilizer (manure) which she then proceeded to distribute in handfuls all around them almost hitting them with it. I have security footage of that incident also.

I have called the police numerous times however I have 2 reports which were filed by me and 3 business cards given to me by the responding officers. Unfortunately she conveniently leaves just prior to them arriving and nothing is ever done. After about and month and 1/2 of her constant harassment and the police unable to make contact I was left with no resolution and it was apparent she just wasn't going to stop. It Finally it got so bad that when she vandalized my cameras for the last time I called thew police and then parked my car in front of hers which was in her assigned spot so that she couldn't leave before the police got there because I wanted the harassment to stop. I realize that I wasn't supposed to do this and of course she through a major fit which was recorded by another neighbor. When the police did show up I was the one that they warned because I blocked her from being able to leave. I realize that I probably shouldn't have done that but i didn't know what else to do things and were getting so bad. I moved my car as soon as they told me too. They spoke with both of us and warned us to have no contact. A couple weeks later when I got a call from the detective handling the case I said that she hadn't done anything major since they had been there and if things stayed that way I would let it go. He said he was going to call her and reiterate that she was to stay away from me. I said thank you and thought that was the end of it.

A month later I received a letter from the Los Angeles City Attorney's office informing me that I was being charged with battery and HAD to appear for a hearing in there office. I immediately called the detective and asking why I was being charged and she wasn't. He explained that this was more of a hearing to decide if charges against me should be pursued after it submitted by them for review. I asked why she wasn't charged and he couldn't really give me an answer and it was the city attorney who made the decision. I was never given the opportunity fro show this detective my evidence before the report was submitted. I told the detective I wanted to pursue both criminal and civil cases against her and he told that criminal charges were not up to me. When I signed the contract with this advertising agency I overlooked the arbitration clause - it provided for me to resolve all disputes via JAMS mandatory arbitration, but for them, who prepared this contract for my signature, the clause provided the opportunity to sue in Small Claims court.

It so happened that they turned out to be cheaters and I took them to Small Claims for my money back. The judge dismissed my law suit and ordered mandatory arbitration. To go through it I need to spent about $2,500.00 t0 $3,000.00. I do not have such money. I paid them $4,500.00 and want my money back. I am trying to file a motion to vacate the judgment based on the fact that the contract has this self-serving clause for them to be able to sue in Small claims but not for me. Is there supporting authority for my position? Can I in my motion to vacate the judgment say that the contract is unequal?

I don't know why you would file a motion to vacate the judgment as there has been no judgment. Was this an employment contract? If so, there is California case law stating that an employee who agrees to an arbitration clause does not have to spend any more money on arbitrating the claim then they would have to if they filed the claim in civil court. In that case, it would simply require a letter to your former employer providing a cite to the case law and stating that you request the arbitration and that they pay all of the costs of arbitration except for those costs you would have had to pay had you filed the claim in civil court (usually around $300-$500).

The other option would be to file your claim in civil court regardless of the fact that there is this arbitration clause, and then if they move to compel the matter to arbitration, you would argue that the arbitration clause is unenforceable due to the fact that it's unequal, requires you to bear the costs of arbitration in excess of that which would be required in a civil case, etc.

Nevermind. I just reread your question and it appears that it was not an employment contract. Rather it appears that you paid them to provide you advertising services. In this case it depends on the contract and the actual arbitration provision. I would have to research whether this particular arbitration clause is enforceable under California law.

Are you saying that the judge in small claims court ordered that the case be arbitrated? Or did he simply dismiss your small claim.

Again, depending on your particular arbitration clause, there would be nothing stopping you from filing your claim in civil court. That would put the onus on your former advertising agency to then move to compel the civil case to arbitration. This would require that they hire an attorney to file the appropriate papers and they may not be willing to spend money on that.

You would then have more negotiating power to try and reach some sort of monetary settlement.

First, was there any warranty on the vehicle? If so, the dealer should be 100% responsible. Even if there was no warranty, the dealer should have known about the compressor and you should sue him in District Justice Court (small claims). You can do this yourself by going to your local DJ's office and the staff will give you some guidance on filling out the Complaint and the whole thing should cost you about 65-75 dollars, which yuo will get back if you win. If you don't feel comfortable about handling this yourself, you sdshould consult with a local attorney. I have a friend who is behind in her mortgage by two months with a Chase loan. (Approximately $3,000.00). She is also behind in her monthly common charges approximately $4,000.00. She is now being threatened by both the bank and Condominium Management Company on foreclosure.

The reason she is behind is that her husband was recently (1 year ago) admitted into a nursing home due to an illness that will eventually lead to his death. Initially she was using his disability check to help pay the mortgage but the nursing home now takes that disability payment for their services.

The vehicle that started the collision would be liable. If the vehicle that hit you did something wrong, they would be liable also. A careful attorney would probably name both drivers as defendants.

That would ordinarily be the case, but when insurance companies get involved, even very simple cases can be made complicated. For example, the carrier for the car in the back of the chain might claim that the vehicle in the middle stopped short, or cut him off. This is a difficult question to answer for a couple reasons:

(1) There are missing facts; AND

(2) This is typically a determination left for the jury to decide.

Having said that, let's take a look at what facts are missing:

(A) Car #1 was stopped/moving? If moving, what speed?

(B) Car #2 was stopped/moving? If moving, what speed?

(C) Distance between Car #1 and Car #2 at time of Car #3's impact?

(D) Property damage to Car #1, Car #2, and Car #3? If so, how much?

(E) What speed was Car #3 traveling at just prior to impact?

I suspect there are certain of these facts that you can answer, but others that you cannot. Without these facts, assumptions will be made. The more assumptions that are made, the more any conclusion that is drawn from it is flawed.

The process of investigation or legal discovery will hash out these facts. With the facts on the table, the conclusions drawn at that time will be more and more accurate.

As to the second issue, when you approach 10 different people with the exact same fact pattern you are undoubtedly going to get differing opinions. That's human nature. That's what you can expect from a jury. That's why there's not always such a simple answer. And, that's why attorneys often answer questions with "It depends."

Unfortunately, that's the reality of the situation. It depends on the missing facts, how people interpret and react to those facts, and how many assumptions are made.

Generally speaking (and taking into consideration that a lot of assumptions are being made at this time), Car #3 will be at fault for starting the chain reaction. Whether or not Car #2 will have fault depends on why and how Car #2 made contact with your car.
