The bank account will go to you directly since it is held jointly with you. You may be able to file for a "Release of Assets" from the probate court where your father resided in order to get the car and any other assets released and distributed to the heirs. If your step father died without a will, unfortunately, then his heirs would inherit, probably not you if you were only a step son and not legally adopted by him. There may be Ohio or Federal Estate taxed owed depending on what the value of his assets were at the time of his death.

Banks have rules. Checking accounts are not wills or trusts, although there are ways of adding people to an account for different purposes. If you don't get the answer you're looking for from someone there on the first try, ask for someone higher up who might be able to explain what they can do for you. The one thing you probably DO NOT want to have is a situation where the added people become responsible if you overdraw the account. Unfortunately the kind of "beneficiary" you may want to have may ONLY be available on a savings account.

If you transferred title to your daughter tomorrow, your daughter has to be listed as an insured under the policy - she would have to be the named insured. Anyone else (you, your wife) could be listed as alternate drivers if you want. I would talk to the insurance company before you go down to the DMV. You can get the title application for the DMV online at http://www.ncdot.gov/dmv.

If you are not on the title, then you cannot be sued so you and your wife can be ok.

Our company is doing custom furniture. One of our clients ordered a custom table. We sent him the invoice with the terms and conditions.In there, there is a cancellation section stating that "Orders are not subject to cancellation. If cancellation is requested and accepted by us with their written acknowledgment, the Buyer will be charged a 25% cancellation fee"

The client approved the invoice and send us the 50% deposit. Then we start working and provide the client with drawings and samples for approval as he says it was urgent. Since then, the client changes his mind already 3 times about the specifications. Now he wants to cancel the order after 2 months of back and forth. He made his own calculation of how much time we spent on the drawing and said that as the production did not start, we can keep a very small amount and reimburse him most of the deposit. He had at the end that he hopes we can resolve this gently.

It seems obvious for me that we should charge the entire 25% cancellation fee especially considering all the time we spent. What is the legal view on this? What should we do?

Answer

I agree with you. You have a written cancelation policy that was assented to buy your customer. In the case of your business this to me seems most reasonable as we are talking about custom work. In fact, one might argue that depending on the amount of effort involved you may even have a claim to be paid above and beyond the 25% deposit under a legal concept of quantum meruit, which basically means you get paid for the services you provided.

Depending on the amount here, you may want to consult a lawyer in private for a proper analysis. But if this is ultimately a small claims matter, you can simply tell your customer that you are keeping his 25% as per your agreement and let him sue you if he wants.

I am sorry for your loss.

You can check the title on the house with the county recorder's office where your mother lived to see if the house was in her name alone, had someone else on title or it was titled in her trust. If she held title as joint tenants with someone else, then the house will pass to that person.

If it is in her name alone and her estate subject to probate is worth more than $150,000, then a court proceeding will be required to either probate her Will if one exists or administer her estate per intestate succession.

The issue with the bank accounts also depends on the titling and the value.

Unless your mother's boyfriend is on title to the house or the accounts, he is only entitled to his own possessions in the house. California does not recognize common law marriages.

If you are concerned about your sister's actions, you should hire a probate attorney to assist you.

If you are concerned as tho the homes contents, either list or video them so you can identify anything that may be removed.

You need a CPA, but if the house and mortgage is in their name they get to deduct the interest not you If they get money from you, then they are supposed to claim it as income and it would be rental income if they are deducting the whole mortgage payment as a rental expense. Unless you just so happen to be making a gift to them of less than $13,000 per year which you pay out as monthly installments that just so happen to equal the mortgage payments.

Your post raises more questions than it answers. Why is this arrangement in place? I think you and your parents need to both consult with a good CPA to find out what will be the most tax advantageous structure for both you and them given that you have set this up this way.

In 2007 I changed jobs and was out of work for a short period of time. In July of 2008 the state of Illinios sent a court order asking the state of Maryland to enforce a child support order and said I was $180.00 past due. I did not contest this action because I agreed. Since that time money has been taken out of my paycheck, sent to MD., and then sent to IL. In October of 2010 I recieved a letter from the state of Illinios saying I was over $5,000.00 past due and owed approx $2,500.00 in interest. They now say I wasn't behind $180.00 and they made a mistake. I tried to go to my previous employer to get the records but unfortunately they are no longer in business, and everything has been destroyed. Is Res Juditaca a viable defense in this situation?

I assume you mean "res judicata". That doctrine applies to cases that have already been decided on their facts in a court of law, so it doesn't apply in this situation. You need to consult with a family attorney, because often these situations can be resolved by negotiation with the other state--especially when there is interest and other fees involved. Apparently you didn't retain your pay stubs from the old job which would indicate how much was deducted from your paycheck. Presumably the arrearage was created while you were between jobs and up until IL caught up with you.

Yes, you can will your half of the house to your daughter. Assuming that you die first, your daughter would then own the property as a tenant in common with your son, albeit after your interest is transferred to her through the probate process.

Both tenants in common have the right to occupy the property, so your son would have no right to have her evicted if she was living there when you passed away.

If the property is encumbered, she would inherit your share subject to the encumbrance, meaning she would have to continue the monthly payments, and could not assume the actual loan unless the lender consented.

She would also have tax issues, and you may want to consult with an estate planning attorney in depth.

The escrow company will not become involved in your dispute. If the two of you cannot come to an agreement on how much of the proceeds each of you receive they will file a interpleader. This a lawsuit in which the escrow company tells the court here is the money husband and wife cannot agree who gets how much therefore the court should make that determination. The fact that she had plenty of money with which to pay for the item doesn't really prove anything. Wealthy people still steal things. Our president and his wife are a prime example. They make plenty of money, and yet they are somehow compelled to steal millions from the citizens every day to spend on non-stop partying and vacationing.

We live in Ohio and now his children live in Florida. It all started almost 4 years ago. They were never married and she chose to leave him. September 2008, She left him. In November 2008 is when i met him. We were picking the children up every other weekend and providing anything that they would need. In 2009 she filed a custody case, she wanted to move to Florida. He did not have an attorney and she did. The judge allowed her to move to Florida before the case was over. Her reason for moving was to better her live but she is in the exact same situation she was in while she was up her. She lives with her boyfriend (which happens to be her step-dads nephew) grandma and has just moved his mother in. Which makes 4 adults and 2 children living in a 3 bedroom house. While down there she agreed to let him pick up the kids, when he went to the airport in Florida, she told him he could not take his children unless he signed this visitation agreement. He signed it because he didn't want to leave his kids standing there wondering why they weren't going with him.

The agreement was never notarized or witnessed. Her lawyer filed that agreement to the court and the case was dismissed.

The visitation agreement says he should only get the kids June, July and August and it says nothing about holidays. Every year she has been lying as to when her plane is leaving from Ohio to go back to Florida. She has been staying in Ohio so that she can stay with her mother a week, which her mother was just charged with drug trafficking. She also has been cutting his time down to just June and July. She called him the other day saying she was going to pick them up on the 1st of August and if he don't like it, oh well and said she will call the cops, if he tries to stop her. She is also not allowing the kids to see him on any holiday. They have only spent 1 Christmas with their father since all of this has been going on. This will be the 3rd year he will not get to see them on Christmas. She also always dangles his kids over his head, saying if you don't do this or that you cant see his kids.

All she cares about is the child support. She always says, if you don't pay me, you will not see your kids.

He wants to go for full custody. All of their family lives in Ohio, mothers and fathers. We are stable have been for 3 years. He has had his job almost three years, He pays his child support. He has been trying to work it out, but she is just so mean to him that he cant take it anymore.

How hard would it be for him to get custody of his sons?

In Ohio, he should make a motion with the Ohio Court having jursidiction over the matter to either modify the visitation agreement so as to allow for holidays and normal Rule 27 visitation, arguing that a change in circumstances has occurred since she has been denying him visitation. Alternately, he could argue that he should get full custody of the children because circumstances are different now then they were when the initial custody order was signed (the mother's drug trafficking, the missed visits, etc).

It will be up to the court at that point to decide the matter. He would do best to hire an attorney to help him with that.

When you say "did not allow you to speak", at what point? Did you try speaking and he said no you can't? Where you making arguments? Where you testifying? Cross examining? Injunction hearings often involve people without attorneys. But you saw the advantage of having an attorney which unfortunately worked against you here for not having one. To be sure, your due process rights were not stifled by the judge, you should talk to an attorney in your area to see if you can file for a new hearing.

If there were no statements there that your ex-husband had any share of the real property and it was provided to you in the divorce and then legally transferred by Quit Claim Deed to you, then if you sold it, he would have no interest in it. However, not sure what the escrow refund is, if that is a refund on utilties, a refund on insurance or something other than actually issues with the real property, that would depend again on if it was addressed in the Final Judgment. If it was not addressed, he is not automatically entitled to it and would have to go back to Court and address and have a court determine if he was entitled to it. I would suggest talking to your divorce attorney or if you did not have one, go see one.

You are in the driver's seat somewhat because their error gives you colorable title. Ultimately, the fact is you did not pay for the car (or the full value of the car) and their mistake is correctable. You may be able to use their mistake to get a better deal, but you cannot use their mistake to your complete advantage. Suggest they reduce their price to obtain your cooperation or you'll force them to go after you legally (which might take considerable time while you drive the car around and reduce it's value). Of course, you cannot break any laws. You should always do the right thing. The right thing means many things to many people. I will leave it up to you has to your next move.

Do not use the name "Audio Consultants" in your name or expect a cease and desist letter as soon as you get your first sign up. Avoid trouble and just pick a name than has not been used. You can always identify the nature of your business as "audio consultants" but you will not be able to get a trademark registration for the name (and be sure to register your new name and any logo you plan to use).

Legally, without permission from the current holder, you may have tradename/trademark issues. However, by calling it Chicagoland Audio Consultants or something similar you probably can have the name incorporated. That will not solve the other issue.

Have you contacted the current user of the name? Perhaps they will allow you to use the name since yours is a niche

business and not a competitor. You never know, you might be able to set up a system of referrals that would benefit both of you.

A name that is not geographic may work if the name is substantially different.

For example, your own last name or first name followed by audio consultants.

Regardless, you should contact an attorney as these are just general ideas that may or may not apply to your situation.

Unless a business has no assets, has filed for bankruptcy or disappeared, it has obligations which it must fulfill. The absence of assets and its disappearance does not eliminate the obligations, it just makes it harder for you to force them into doing what they are suppose to do. You need to look at your contracts to determine who is actually providing the warranty. If the business is out of business, there may be an insurance company that was used to pay for warranty work.

Anything is possible but if you have never been in trouble, they are not likely to help her. She was actually in possession of the drugs - they CAN prove the case on her. If they decided to accept your confession, they may proceed against both of you.

If you really want to try to help (and I say try because it may not work), talk with her lawyer. Be aware that you may only add yourself to the mix because she is technically guilty.

If it was at a deposition, you will have a chance to correct the transcript, although the other side could comment on your changed testimony at trial or elsewhere. The practical answer is "yes," because what are you going to do, sue your own corporation for wage and hour violations? The bigger issue, really, is that your business and compensation models appear to be HUGELY tax disadvantaged. Why in heavens name would you pay all the extra taxes of being employees, when you can just elect S-Corp tax status and be paid as if you were partners, with the legal protections of the corporate form? You REALLY need to hire a good tax accountant before you create a huge tax burden for no reason. Your issues are tax and financial, not legal, at least for now.

To be extra safe, within 21 days of his telling you of the change in mind, send him a registered letter stating that he gave you $x as a security deposit and you gave him that full sum back on , and that he gave you $Y on as first month's rent and you told him that under the lease he signed he is liable for the rent for thirty days from the date he told you he did not want to go through, plus the days you took it off thee market because he gave you a rental check and signed the lease, but that you are attempting to mitigate damages byre-renting ASAP and once you have a tenant in and it is clear that they will be staying and paying the rent, you will refund the prorate amount.

In order to charge rent until you get a new tenant in, YOU, not the defaulting prospective tenant, must take all commercially reasonable steps to find a new tenant. 1. find the insurance. If you can't find the policy or policies, look through effects for calendars from brokers. Check your father's email to identify the broker. Check bank records for cancelled checks, premium payments, etc.

2. notify the insurance company of the suit. Make sure you assert this is your first notice.

3. you might want to hire an attorney to handle the insurance/claims side, since Trusts&Estates;attorneys are good at what they do but it does not include insurance coverage and claims. This stuff can be tricky, especially to one who does not practice in insurance.

4. if Dad had commercial liability insurance then you are automatically covered as his executor. If not, then get your own coverage in place ASAP. You may have an exposure to personal liability that could exceed the value of the estate by orders of magnitude. You can't duck the liability if you have "qualified" as executor. If letters testamentary have NOT been issued then tell the T&E lawyer to stop work immediately, as you may need to renounce being executor.

You can file your own divorce in any court in the world. You are never required to hire a lawyer, just like you are never requried to see a doctor for medical advice. However, going to court without a lawyer is about the same as attempting surgery on yourself.

It's that "How do you get started" part of your question that is the rub. Even if an attorney would be willing to walk you through the process for free, he or she couldn't take the risk that you would screw something up and then sue their malpractice insurer for the "bad advice". For the attorney, it would be all risk and wasted time and skill with no offsetting benefit.

The divorce and child custody process is very intricate and involved (especially with minor children invovled) and it is literally loaded with procedural pitfalls for the uninitiated or unwary. The process is so byzantine that many lawyers (including myself) won't take on domestic cases. Your odds of navigating that process successfully without a lawyer are probably about the same as successfully removing a tumor out of your abdomen without a doctor.

There are a ton of good lawyers who will handle an uncontested divorce very inexpensively (probably less than $1,000.00). Please, take my advice, prioritize your income and hire one of them.

If you absolutely insist on moving forward yourself, I would suggest that you start at your local law library. There are several books and articles you can find about the divorce process. It will be long and hard hours. Good luck.
