Question

Can a court case be used to set prescedent (no matter what state the case was tried in) at a trial/court hearing? For example, if a person was injured by firework display and wants to sue the host, the person shooting the display and the township. If there was a case in a different state which is similar could that be used? Or does it have to be within the same state? Also, this could be under a few different laws, personal injury, wrongful death (if that's the case) neglegience so I wasn't sure which one to pick down below. Thank you for your time and assistance.

Answer

The laws of each state are different, so usually it doesn't matter. If there is no law on a topic, then it may be persuasive, but certainly not binding. Tim Klisz
