My father in law was in Peru and stayed there for over 1 year because he was sick. Then he lost his greencard (permanent resident card). He went to the US embassy and they told him he could not come back to the US. Then he applied for a visa to come here to visit, and the US embassy granted him with a Visa. Now he's here with a visa visiting. Can he apply for a US resident card again? Or should he just ask for another resident card saying it was lost?

That would depend on whether his greencard was revoked due to abandonment. If not, he can apply to replace his greencard on Form I-90. If so, he can either fight the case for abandonment or reapply altogether.

This will all depend on the contract and the value of the goods sold or services sold.

If this is a sale of goods more than 500 dollars you should have something in writing. If it is a custom good there are exceptions... You need to look to your agreement. If not the California Commercial Commercial Code will give you a better idea.

If there are none, we would look to the provisions of the Commercial Code to determine when title passes and when the buyer's right to inspect and reject terminated. Finally, there is always the question as to whether keeping the customer's favor warrants taking back this server and furnishing another that meets their needs. It happened at your job during the course of your employment and it is reasonably expected that such an injury would occur. You need to SEE an attorney about your case. Get on the phone with somebody.

If you were injured on the job, and it appears you were, I don't see how they can deny the claim. Is your physician relating everything to the assault? You would need an authorized physician (authorized by the workers compensation insurance carrier) to say that you were injured by the assault, that your current symptoms are related to the injury, and that you need time off of work in order to recover. If you are not satisfied with your current doctor, you can request a panel of four doctors to choose from, but note that you only get one panel. After that, they do not have to provide you with another doctor unless your authorized physician refers you to another specialist.

We are currently going through a foreclosure of a home my husband built in 1996. The home is built on land he already owned from an inheritance. The amount of land was a little over 18 acres. We refinanced the house in 2002 and were assured that only the home and 1 acre of land surrounding the home were included. As this land was paid for when the house was built, it was never intended to be included in the financing of the home. Now with the economic downturn, several job losses and huge cuts in our collective household income, we have unfortunately become unable to meet the monthly mortgage payment and foreclosure has begun. A few years ago, my husband's sister wanted to purchase a portion of the land to give to her son to someday build on. A title search was done, and the land she wanted had no liens on it, so we sold her that land. When we were served in connection with the foreclosure, she was served also. I have gone back and read the original mortgage papers and though I struggled to keep up with the jargon, it never says in the papers anything about the land - mostly a reference to a deed of trust - which I read and have no clue what I read. So I guess my question is can this mortgage company foreclose on our home and take with it an additional $60,000 (give or take) worth of land - some of which is no longer in our possession?

Possibly - you will really need to consult with a real estate attorney. The first issue is what is encumbered - in order to find that out, you have to look at the legal description in the deed of trust. If the entire land is not encumbered, then the Bank has no rights to it but you still have to get this straightened out if they think they have rights to it. If the entire land was encumbered, then you have to consult with someone if you have any claims against the bank for reformation of that deed of trust. Meanwhile your husband's sister needs to contact her title insurance company right away and let them know because they should step in and help her.

Its not a problem. If you have less than $300 in the bank (get your name off any bank accounts with your husband) and no assets, there is not a darn thing they can do to you. There is no wage garnishment in PA.

They do not have to settle the debt for less than 100%, although many creditors want paid badly enough and will settle for 50% to 80% on average. Also, creditors do not have to allow you to make payments and many want paid either in a lump sum or in no less than 3 payments. Others are more flexible and will let you pay out over 12 months.

If they are telling you no, then tell them that if they are not going to be flexible then you are going to have to save. Start saving now. I don't know how much the judgment is for or how much they want. The judgment will earn interest at rate of 6% so it will be bigger, but when you have at least 50% saved (make sure that you get an updated balance; you can contact the court to get the information or just ask the creditor), contact the creditor and see if they will accept. If they ask for more, then see if you can make a down payment and get the balance paid off in 3 or less pays. If the creditor says no, then keep on saving until you have more and try again.

I signed a contract to sell my land to a builder thinking that I was giving him up to year to close on the sale. However, on closer examination of the contract, the year to close starts ticking after I would obtain an easement from the owner of a neighboring property. This was not my understanding when signing the contract, but this is the wording (mea culpa). However, after I had already signed this contract with the builder, the owner of the neighboring property decided that he wanted to buy my property, and therefore will not agree to the easement. Unless I agree to the builder's terms to cancel the contract (e.g. earnest money back plus lots of cash), he thinks that he could hold onto my property indefinately without closing and prevent me from selling to somone else. Is he correct? What can I do with this mess?

You can go to court to have the contract declared void due to frustration of conditions or due to your own breach of its conditions. You have probably breached the contract due to your inability to get the easement. The contract almost certainly has provisions that say what happens in the event of a breach of contract. Probably you get the land back and have to repay the earnest money to the buyer. The buyer is probably not entitled to anything more from you. If he is entitled to anything more, it would probably be the difference in the value of the property now and what he agreed to pay for it. Say the property now is worth $1 million and you had agreed to sell it to him for $800,000. Then you might conceivably have to pay him $200,000 in damages so that he receives the "benefit of the bargain." As noted above, it is likely that repaying the earnest money will be all that the court orders. It depends on what the contract says happens in case of breach or frustration of purpose due to unavoidable conditions.

They can better assess your exposure, after looking at the documents and asking you follow-up questions.

Unless you're covered by a collective bargaining agreement or other "written" contract, employment is "at will" here in Illinois. That means he can fire you anytime, and you can quit anytime. It also means he can change the job description or duties anytime.... Sometimes employers will start making things difficult (like this) just because they really have another reason to get rid of you but the reason is illegal.... But if you can't clearly identify whether there is another reason that may be illegal (race, gender, other protected classes of people), you may be stuck cleaning and performing other tasks even if they are totally unrelated to what you were supposedly hired for. Other employers simply stop giving disliked employees work until the employee feels guilty about sitting around doing nothing and then quits. It takes all kinds. But if you think there is another reason and it might be an illegal reason, or if you just want someone to ask for you to see what is going on, see an attorney who handles labor and employment cases in your area. Jobs are tough enough to find for a lot of people and many people are just sucking up and doing whatever it is to keep a job if they have one.....

We had a temp court order 3/11 stating "the court orders that neither parent is to change the childs current school pending further order of the court and/or written agreement of the parties." we went back to court to finalize the 50/50 9/11 and in the order it just gives verbage of joint legal custody and stats "all prior order not in conflict with the orders herein shall remain in full force and effect end of all other orders."

So I am able to use the 3/11 document so she can not disenroll her from her current feeder middle school? I want to make sure it just doesnt apply to elementy school as she has to move up. My daughter has a lot of social/emotional issues and I dont think it would be in the best interest to move her to a middle school where she know no one. We live in California is that makes a difference.

If the 6th grade is currently in the same middle school that she has been attending, it would appear that both court orders read together would suggest that the child not be moved without court order or written agreement. This is assuming that there is nothing in the May order that conflicts with that particular order from the 3/11 hearing.

You may also open communications with the school to advise that the school cannot be changed without a court order or the agreement of both parties. It sounds like they abandoned their stuff. If you have made a good faith effort to find them, and document that effort, (send them a letter to your address and see if its forwarded). After 30 days, I think you can with the property as you please. You are not a warehouseman and never promised to store their stuff. If you do find them you should sue them in your local district justice court (small claims court).

We have a significan amount of other debt that already qualifies us for claiming bankruptcy, we just haven't had the funds to do it. But if it means it would save our home, we would find a way to pay for the bankruptcy. Chapter 7 will not help you with the mortgage at all. Only Chapter 13 will allow you 5 years to repay the arrears. But you need to be able to resume making monthly mortgage payments and a plan payment for the arrears. If you cannot do that, Chapter 7 may at least eliminate your unsecured debt.

You have several options. The most important issue is your health and the landlord has an obligation to take reasonable steps not ot permit an unsafe or illegal activity to occur or continue to exist on his property that threatens you or your health and well-being.If he fails to take action you have the right to move out and let him know if he does not take action to abate the unsafe condition you will have no alternative but to terminate the lease. I am surprised that the police did nothing. I would call again and make sure they know that this is a continuing course of conduct in the apartment above you and that you have a health condition. If the police continue to ignore the problem contact your local proseuctors office as the police have a duty to enforce the law and if they know you have a medical condition and they fail to enforce the law you have rights arising from that. I would write to the landlord and demand he take action immediately otherwise you will have to consider your options including terminating the lease as the tenants conduct is illegal and causes you health concerns and problems. Generally, the statute of limitation for a worker's compensation claim is three years from the date of the incident. I never recommend making a WC claim without the help of an attorney. In such a claim no one is on the side of the victim and the only way to make sure that your husband's interest is properly protected is to have an attorney working for him on his side. A WC attorney works on a contingency basis (maxed at 20%) and generally it doesn't cost anything to have an initial consultation.

The statute of limitations on a work injury is three years, however; if the insurance company has set an IME and "changed their tune" as you suggested, you likely need representation immediatley. Having handled work injury cases for over ten years, typically when the insurnace carrier sets an IME, they are doing so because they want to cut off your benefits or determine they should not continue paying for your medicla care. Many times, there is no good basis for cutting off these benefits and an experienced attorney can help you navagate through these issues with the insurance company - without interrupting your benefits. Alternatively, the insurance company remains insistant on cutting off benefits, an attorney can file an immediate hearing to attempt to get these benefits paid for you.

The largest share holders are responsible for certain employees wages even if company is dissolved. An example is salespeople. Salespeople can also get triple damages.

Additionally using checks on an account you know its closed is fraud and a criminal complaint can be made, but in general NYC District Attorneys don't proceed on these matters and say it is a civil matter.

Leaving a job without notice is not legally wrong unless there is an agreement or an employee booklet with rights and responsibilities.

It sounds like you have the information properly lined up, but you may want to hire a lawyer if its a large sum or to just review the file and help you arrange the case for trial. They would also be able to advise if you should add any claims. For example if the bad checks were mailed to you, or had phone conversations with him regarding the amounts owed, you could have a RICO claim on those amounts which would triple the amount you could claim.

Yes, basically correct. Technically the life tenant is entitled to reimbursement for the portion of the mortgage payment that reduces the principal owed on the mortgage, but because on most mortgages that is a very small amount of the mortgage payment, it is usually a non-issue. If, however, the mortgage has been in place so long that the principal is a major part of the mortgage payment, it is usually in the interest of both the life tenant and the remainderman(men) to refinance the mortgage. This has the double benefit of reducing the life tenant's monthly payments AND resetting the amortization of the mortgage so that there is very little principal payment to worry about.

Generally, you will not be entitled to a Court appointed attorney for custody matters in North Carolina only criminal matters. Are you certain you had a Court appointed attorney? I suspect you are confusing Court appointed with some sort of Legal Aid program. If you do some how have a Court appointed attorney, you are generally stuck with them. However, like any other licensed attorney in NC if they are not doing their job you may report the issue to the State Bar - if there is a State Bar complaint, the Court may appoint new counsel to you.

If your order was prepared correctly your ex-wife would be paid directly and they would deduct your taxes from your share and her taxes from her share, so the 25% would not be an issue. At the current time you have a mess, depending upon the state of the orders from the court and their specific wording. However, if one parent takes the child and leaves the state, the other parent has 6 months to bring a custody action in NC and can ask for the return of the child and seek custody.

Litigation, especially custody litigation, can get very expensive very quickly. It is better to be proactive than reactive. If I were you, I would get a formal custody order in place now before the other parent leaves the state with the child or I would at least get a custody agreement in place and require the other parent to give 60 days' notice of any intent to leave the state with the child unless its for a vacation.

No contractor who does not have a license can make use of any of the mechanics lien or stop notice procedures for collecting payment for work. In fact, any contractor who does not have a license can even be sued and forced to return any payments they have received. If a subcontractor records a lien, he must first give the owner what is commonly referred to as a "20-day Notice," because it must be given within 20 days of starting work or delivering materials to the project. In that notice the subcontractor must tell the owner who the contractor is that the subcontractor is working for. That is not always the general contractor, though. Sometimes a subcontractor to the general contractor will sub-subcontract part of the work, such as when an interior finish subcontractor, sub-subcontracts the kitchen cabinet work to a specialty cabinet fabrication and installation shop. As for the rest of your question, I can't figure out any way it makes sense. How can a general contractor, who by definition must have a contract with the owner, hide who he is? He can't have a contract out of thin air with an owner who doesn't even know who he is.

A licensed subcontractor or a supplier of materials, etc. can record a lien for what they themselves are owed for work done, materials furnished, etc., and their 20-day preliminary notices must give the name and address of the party who hired or bought from them, which may be the general contractor, but these subs and materials suppliers cannot act as collection agents for the illegal contractor. Since your question discusses an "authority/government body," I assume this is a public works contract. How he ever got the contract in the first place without holding a license is a mystery; most public contracts are awarded too carefully for that .... was there some fraud in the bidding process? I don't know the likely outcome but I'd say the contractor will be contacted somehow and asked a bunch of questions.

The clock starts ticking on the day after the maturity date; however, the pawnbroker can extend the maturity date if he does so in writing.

PTI is a form of probation where if you keep up with the program, after a year or two then the charge against you would be dismissed. There is no law that requires employers to provide paid time off to any employee. It is a benefit that may be offered by employers either as a policy or by contract. It is left to the employer to decide what level of employee it wishes to provide benefits to. If the employer wishes to provide paid time off to one class of employee but not another, there is nothing unlawful about that, as long as it is not done on a discriminatory basis.

However, once paid time off has been accrued, it is deemed earned as a form of wage, and cannot be forfeited. If you are saying you have earned some PTO but the company refuses to pay it because you were promoted, you may have a basis for a claim. You would have to consult with an employment law attorney for a more definitive legal opinion and to help you decide whether it is worth pursuing.

I don't disagree with Mr. Kirschbaum, but I think he is making assumptions that are not necessarily supported by your question. Specifically he is assuming that "paid time off" and "vacation" are synonymous. While some employers attempt to avoid the requirement that unused vacation be paid on resignation or termination by calling everything "paid time off" they generally just make a mess of things for themselves and are held to be calling vacation another name. So most well informed and advised employers use the term "paid time off" in lieu of "sick time." Since the employers are required to give time off under family leave laws for purposes other than the employee's illness, and since employees are happier if they have at least a few hours a year to take off for personal business, many employers have a truly non-vacation bank of paid time off available to employees, separate and different from the employee's vacation accrual. If that is what your employer does, and you are talking about true PTO, and not vacation or vacation disguised as PTO, then your employer has the right to strip the PTO and not give you any more at any time as long as it is not done in a way that discriminates on some illegal basis such as race, gender, age, etc.

They are copyrighted whether or not you registered them. The copyright simply makes it easier to prove. You could sue for infringement, etc, but my guess is the the best you can do would be compensation for what the pictures would have earned you.
